Yann Choucq

Yann Choucq , is a lawyer French, specialist in the rights of the national minorities in Europe, and a political militant of the Breton Nationalisme.

Biography

Yann Choucq creates in 1968 the Breton political group of left Sav Breizh ( Debout Brittany ) with Erwan Valerie and Yannick Jezequel. Young training lawyer, he is the initiator, with Xavier Grall and Gwenc' hlan Scouëzec, at the beginning of the Années 1970 of Skoazell Vreizh , the “Breton Help”, an support group with the families of the Breton political prisoners. He is also the organizer of the Nantes committee of the Breton Collectif for the democracy and the human rights . He is regularly the defender of the Breton militants in front of the courts: lawsuit of the FAS, Business of Plévin, etc, of the demonstrators of Plogoff, Basque militants.

The March 6th 1980, defending in front of the Magistrates' court of Quimper, some young people, the majority students, shown to have taken part in a violent demonstration of protest against a nuclear installation, Yann Choucq realizes that one of the demonstrators, who had however been stopped with his/her comrades, is not among the defendants. However, this one is the son of the Public prosecutor. He makes the remark with the court of it: “I do not want to believe that the family ties of young Mr. the Arm with a representative of the Parquet had an unspecified influence on the fact that it was slackened. ” This simple sentence will start a sharp polemic. The public ministry rises and shouts with the Contempt of court. It takes requisitions in this direction against Me Choucq. The court takes note of these requisitions, but modifies them, estimating that it there has Délit of audience within the meaning of article 25 of the law of December 31st, 1971, and condemns to Me Choucq for “this failure to the obligations which its oath” with a ten day old imposes to him suspension, applicable immediately. The lawyer, constrained to give up the bar, is at once driven out court. This business will raise a considerable emotion among the lawyers, who see in this application of article 25 an intolerable attack to the Droits of defense. The mobilization of the profession is such as the government of the time decides, in the urgency, to modify article 25. It did it in article 66-2 of the famous law known as safety and freedom , voted the December 23rd 1980, but in such a manner that these provisions will be censured by the Constitutional council, which, for the first time, proclaims that the Droits defense belong to this block of the Fundamental freedoms protected by the Constitution!

In 1994, it assists a magistrate, continued in front of the Disciplinary commission of the parquet floor of the Superior council of the magistrature, for “lack within the meaning of its responsibilities and with the duties for its state of magistrate of the parquet floor”, but it does not manage to avoid with this magistrate the disciplinary action (displacement of office) that the Council pronounces in its opinion, considering that the facts complained of to the magistrate characterize “a serious persistent deficiency and a personnel shortage. ”

The March 2nd 2004, at the time of a lawsuit of Breton militants in front of a special Court of Assizes with Paris, Yann Choucq blames the legitimacy of this authority: “You are not qualified to judge us” declares it with the judges of this jurisdiction of exception, which it compares with the Cour State security, today disappeared, adding that this court “is not compatible with a democratic justice. ” In 2007, Yann Choucq mobilizes against the project of recasting of the legal Carte prepared by the Ministère of Justice. With a certain number of lawyers, brought together within a collective entitled the Lawyers of Brittany , from which it is with Yvon Olivier carries it word, it launches the July 5th a petition claiming the respect of the Breton legal traditions: “For thousand years, it has been with Rennes that the legal affairs of Brittany are evoked in call, by the ducal Cour, the Parlement then and from now on by our Court of Appeal. Today, the legal spring remains that of the historical Brittany. ”

Yann Choucq, representing the Breton Committee of the Human rights , belonged to a Breton delegation of seven people received - among the representatives of other French minorities - with the seat of UNESCO to Paris, the September 20th 2007, by expert independent on the questions of the minorities, working for the Haut-Commissariat of the United Nations to the human rights. The Breton delegates made share on expert subjects which worry Brittany, giving a bulky file to him, and announced the imminence of a “action in failure” against the French Republic near the European commission.
