Legitimation and ethical point of view

The use of the force can be legitimated. The self-defense, when the victim of violence is defended by the force, or when an army in war causes violent deaths under the responsibility of a State, within the framework of the international treaties of war.

It can be not legitimated like the free violence, which is an act moved by internal psychic causes with the belligerent and, juridically admissible for a possible grace; in which case a psychiatric treatment of the violent one becomes necessary. Not still legitimated when the actor of violence knowingly acts with premeditation in order to make an offense: flight, Kidnapping; in which case a legal treatment and Social of the violent one become necessary.

The question of violence, and in particular of the Homicide, the Rape and the Torture, is so recurring in the human history which the religions were brought to decide about it.

  • sometimes for the to prohibit (“you will not kill” in the the Ten Commands),
  • sometimes for the instrumentaliser (human sacrifices)
  • sometimes finally for the to codify in well defined formal cases: war (of which legitimacy does not seem disputed by any religion (except the Quaker S), possible Capital punishment, etc
