A victim is a person who suffers a damage personally. It is a person who undergoes the ill treatments, the injustices of others, or which undergoes the consequences of an accident, a catastrophe, a cataclysm.

It is one of the three people of the Triade victim-saver-persecutor.

Victim of a damage of public works

In administrative law , one considers that the public Ouvrage or the public Travail must benefit all pareillement. This equality is broken if somebody who with paid the work (by the tax) is not profit (because victim). This victim can then have three statutes:
  • the participating victim : it is not in the situation most favorable for the victim, since it draws an advantage from work or public work. One thus applies to him a mode of responsibility for fault (i.e of common right). It is with the victim to bring the proof of the fault of the administration.

  • the victim user : she must make a direct use of the public work. It then applies the mode of responsibility for supposed fault of the administration.

  • the victim third : it is the most advantageous case for the victim. The simple presumption of fault can however be reversed if there is no normal Permissive waste. It applies the mode of responsibility without fault .
