Trading of favors

The trading of favors is an offense which consists in receiving gifts (money, goods) to support the interests of a natural person or morals near the public authorities. It is a form of Corruption.

To dam up this phenomenon, the Jurisprudence and the doctrines estimate besides that the possibly authorized or promised advantages do not even need to give place to the favorisation by influence of the applicant to be constitutive of the infringement. In that one says trading of favors which it is a formal Infraction.

In criminal Law French, this infringement is repressed, whether one is active or passive in this trading of favors. In all the cases, it is punished 10 years of Emprisonnement and 150.000 € of Amende. Complementary sorrows are possible like:

  • the prohibition of the civic rights, civil and of family;
  • prohibition, for one five years duration at most, to exert a public office or to carry on the community activity or social in the exercise or at the time of the exercise of which the infringement was made;
  • the posting or diffusion of the decision pronounced under the conditions envisaged by the article.
