Therapeutic eagerness

The therapeutic eagerness indicates the artificial maintenance in Vie of a dying patient for whom one has any more no hope of improvement or stabilization of a physiological state considered to be precarious: The Nobody can live more without the machines or the painful treatments only one places at his disposal (Respirateur S, Médicament S with strong side effects).

Therapeutic eagerness and euthanasia

The difficulty of the therapeutic theory of not-eagerness lies in its limit with the Euthanasie. Indeed, the euthanasia consists in leading to dead sick individual. Then, the fact of disconnecting the machines leading to the Dead, is this euthanasia or a murder by compassion?

Interest of the difference

The difference is not without interest because the euthanasia is always punished by the French penal code under article on the murder. The Euthanasie is thus with the eyes of the law only a crime.
In a rather caricatural way, therapeutic not-eagerness can be different by the fact that it consists of an inaction: not to look after a patient. However, if to disconnect a machine is an action, it would rather be a question of a Euthanasie.

Definition of the Catholic church

“It is necessary to distinguish from the Euthanasie the decision to what is called give up the therapeutic eagerness , i.e. with certain medical interventions which are not appropriate any more for the real situation of the patient, because they are from now on disproportionate compared to the results which one could expect or because they are too heavy for him and for his family. In these situations, when death is announced imminent and inevitable, one can in conscience " to give up treatments which would get only one precarious and painful deferment of the life, without however stopping the care due to the patient into similar cas" ” Evangelium vitae n°65

In a document approved by the pope Benoit XVI, the Congregation for the doctrines of the faith estimates that the artificial food and the hydration constitute " a means ordinary and proportioned maintenance of the vie" , which should be stopped under no pretext by respect for the dignity of the patients.
