Territorial Directive of installation

The territorial directing of installation (DTA) is a French legal tool allowing a community, on a territory given to formulate obligations or a particular framework relating to the Environnement or the Town and country planning.

Created by the Law Pasqua of February 4th, 1995, the DTA saw their legal mode transformed by the Loi Voynet, and they can apply for example within the framework of the regional Schéma of installation and development of the territory, on ground or the maritime public domain.

It is at the same time a document of town and country planning and a Document of town planning, elaborate under the responsibility of the State in partnership with the territorial collectivities and the groupings of communes concerned, then approved by decree in Council of State.

An experimental application of this tool is possible, with the follow-up and contest of the State.

Legal mode

The territorial Directives of installation are defined in the article, which specifies the objectives, the effects and the methods of development of these devices.

In the lawful hierarchy, the DTA is essential on the documents town planning, which must respect a bond of compatibility with the DTA. It is the same for the Plan of urban displacements (PDU). SCOT must be compatible with the DTA. In the absence of SCOT, the RAINED and the communal charts must be compatible with the DTA.

List DTA

Twenty two DTA were considered at the beginning. Finally, seven are retained.

The seven territorial directives of installation selected are:

the territorial directive of installation of the Alpes-Maritimes (Decree n° 2003-1169 of December 2nd, 2003);
the territorial directive of installation of the fields Northern Lorraine (Decree n° 2005-918 of August 2nd, 2005);
the territorial directive of installation of the estuary of the Loire (Decree n° 2006-884 of July 17th, 2006);
the territorial directive of installation of the Lyons metropolitan surface (Decree n° 2007-45 of January 9th, 2007);
the territorial directive of installation of the Rhone delta (Decree n° 2007-779 of May 10th, 2007);
the territorial directive of installation of the Alps of North (No decree of approval);
the territorial directive of installation of the estuary of the Seine (Decree n° 2006-834 of July 10th, 2006).

In September 2007, only six DTA were approved by decree as a Council of State.
