Supreme court (Cameroun)

With the Cameroun, the Supreme court is more the high jurisdiction out of legal, administrative matter and of judgment of the accounts. She exerts on a purely temporary basis the function of Constitutional council while waiting for the installation of this one (since 1996).

She is divided into three specialized rooms:

  • a legal room;
  • an administrative chamber;
  • a room of the accounts.

The legal room rules supremely on:

  • the appeal to the Supreme Court admitted by the law against the decisions returned in last spring by the courses and the courts of the legal order;
  • decisions of the lower jurisdictions of the legal order become final whenever the application of the right is in question.

The room of the accounts is qualified to control and rule on the public accounts and those of the state enterprises and parapublic.

Composition of the supreme court

The law No 76/28 of December 14th 1976 lays down the procedure of the supreme court.

The Supreme court includes/understands:

  • a president;
  • of the presidents of room;
  • of the titular or temporary advisers;
  • a Public prosecutor;
  • of prosecuting attorneys;
  • of the general substitutes;
  • a clerk as a chief and clerks.

The presidency is taken by the oldest Magistrat of the Court in the highest rank.

Operation

Any business submitted to the Court is judged by five magistrates, members of the Court, except for the appeals where, according to the need for service, three members of the Court can be enough

The president of the Supreme court or his delegate only rules on the procedures in summary procedure and the ordinances on request.

International relations

The Supreme court is member of the Association of the High jurisdictions of cassation of the countries having shares of it the use of French (AHJUCAF).
