Statute of autonomy of the Valencian Community

The Statut of Autonomy of the Valencian Community ( Estatut d' Autonomia del País Valencià in Valencian, Estatuto de Autonomía of Comunidad Valenciana in Castillan) is the basic standard of the Valencian Communauté, approved in 1982, which regulates the operation of its bodies of government, the Valencian Généralité.

The Statute of Autonomy is the first in force, since the abolition of the Furs de Valence by the Décrets of Nueva Planta; it makes it possible the Valencian Community to enjoy a certain capacity of self-government.

The Statute was approved by LEY ORGÁNICA 5/1982, Of July 1st, ESTATUTO OF AUTONOMÍA OF COMUNIDAD VALENCIANA núm. 74, of 15 of julio.

Reform Statute (2005-)

In May 2005, the the Cortes Valencianas discussed a new statute.

The Valencian Communauté was the first to present a reform of its statute of autonomy in front of the Congrès of the deputies. This reform was approved by the '' the Cortes Valencianas '' by 83 votes for (PP and PSPV-PSOE) and 6 votes against (Entesa) on July 1st 2005. The reform had been the subject of an prior agreement between PP and the PSPV-PSOE.

Not obstant, lasting the discussion of the statute in front of the Spanish cortes , PSPV-PSOE expressed beforehand its intention to amend which it had accepted in front of the the Cortes valencianas . These modifications related to the Valencian language and the electoral threshold of 3% to be able to reach the Valencie Parliament. The modifications were claimed by the nationalist parties, as well Valencian as Catalan, because the fall of the electoral threshold from 5% to 3% allowed the entry the Valencian Parliament of the Bloc Nacionalista Valencià .

In the final text of the Statute ratified by the Spanish Parliament, one maintained the denomination Valencian Idiome , that the defenders of the unit of the Catalan and the Valencian do not accept, and one jumped the question of the electoral threshold by leaving it to 5%, but it could be modified by a Valencian Law, which will require a qualified majority of two thirds to be approved.

The reform project of the Statute of the Valencian Community was approved with the Congress of the deputies by 294 votes for (PSOE, PP there DC) and 32 against (CiU, ERC, PNV, IU-ICV and Grupo Mixto)

Currently, the reform of the Statute remains suspended with its ratification by the Valencian Parliament, because of a characteristic of the reform of the Statute of Autonomy of the Valencian Community; indeed once discussed and approved by the Spanish cortes , it must turn over in front of the the Cortes Valencianas to be approved finally, if one would have introduced modifications nondesired by the the Cortes Valencianas . On the other hand, there will be no referendum for its approval, as it is the case of the Catalan Statute, for example.
