Sefer Hamitzvot leRambam

The Sefer Hamitzvot the Rambam is a comput regulations found in the Torah, in order to add up 613 mitzvot like wants it the rabbinical tradition.

Originally written with in Judéo-Arabic and appeared under the title of " Kitab Al-Farai' D " , it was translated by the rabbi of Provence Moïse ibn Tibbon, and was printed for the first time in 1497. A new translation was carried out with starting from the original by Yosseph Qaffah.

First steps

In this work, Moïse Maïmonide establishes the comput 613 mitzvot, that it subdivides in 248 positive regulations (“for each member of the body”) and 365 negative (“for each day of the solar year”).

Its method of selection rests on the application of fourteen principles, for which it provides abundant illustrations by example:

  1. the regulations of rabbinical institution, like the Hallel, instituted in order to comply with the biblical regulations more are not counted.
  2. the regulations deduced starting from the interpretation from the verses, in particular to the 13 principles of Rabbi Ishmaël are not counted.
  3. *Cette rule excludes for example the regulation from révérer the scholars in Torah, because it is the fruit of a deduction of Rabbi Akiva from “You will révéreras the Eternal, your God. ”
  4. the regulations limited in time are not counted.
  5. * This rule excludes prohibition for a old Lévite of more than 50 years to fill the service in the Tabernacle (Nombres 8:25).
  6. the regulations including the Torah as a whole are not counted.
  7. * This rule excludes the regulation from " to keep all that I have you dit" (Exodus 23:13).
  8. the reason of a regulation is not counted like a regulation in oneself.
  9. * For example, the Torah prohibited a woman from marrying one second time its first husband if she had married meanwhile with a second husband. When the Torah adds “and the culpability does not bring on the ground,” it is about an assertion explaining the prohibition which precedes it. It is thus not counted like a separate regulation.
  10. For a command containing as well positive injunctions as negative injunctions, the positive component counts for a positive regulation, while the negative component counts for a negative regulation.
  11. * the Torah prescribes to rest with Shabbat and interdict to work in this day. The rest counts like positive regulation, work like a negative regulation.
  12. the details of a regulation, relating to the way of applying it, are not counted.
  13. * the Torah orders from certain sinners to lead “an animal (cattle) to offer it in sacrifice of atonement. If they do not have the means of them, they can bring two birds, in the places of these animals; and if they cannot be allowed to offer birds, they can bring an offering of flour in compensation. ” A sinning rich person must thus sacrifice an animal, but a stripped sinner brings a flower of flour. This type of variable expiatory sacrifice in importance ( korban “olè vèyorèd ) account for only one regulation, although containing three possibility different, according to the economic level of the individual.
  14. negation of an obligation ( shelila , " is not pas") does not have to be treated as a prohibition ( will azhara , " do not make pas"). Although obvious at first sight, ambiguity is however more important in the text, because lo , the Hebraic term for not can as well as acquire the direction of shelila of will azhara.
  15. * According to this rule, the assertion which a Jewish maidservant “will not leave main the made-to-order of the other slaves” is not a regulation. The comprehension of lo as a shelila means that if the Master were to cause a physical damage with his maidservant, like the loss of an eye, a tooth or a member, it cannot free it like an ordinary maidservant, but must marry it; as a will azhara , the sentence would mean that it is interdict with the maidservant to leave her Master, contrary with being useful ordinary. The direction of the verse is thus a factual assertion, and not a prohibition, and this one cannot count in the negative regulations.
  16. the same instruction, or prohibition, repeated several times counts only once.
  17. * the Torah prohibited to eat blood in seven different verses (Lev. 3:17, 7:26, etc), but that count only for one prohibition.
  18. the preliminaries with the realization of a command are not counted separately.
  19. * It is prescribed with the '' cohanim '' to expose the bread of presentation on the Table in the Tabernacle. Details referring to the way of cooking the bread (Lev. 24:5 - 7) are not counted.
  20. the various methods of realization of a command are not counted not separately only if their combination is necessary to the achievement of this command.
  21. * the Four species of Souccot ( etrog, loulav, hadass, “arava ) are regarded as being a command and not four, this command which cannot be accomplished by a person if it does not have the four species.
  22. the acts necessary to achieve a command are not counted separately.
  23. * the demolition of an offering in holocaust, the sprinkling of its blood, the withdrawal of the skin of the animal, etc are not counted separately. The command relates on the contrary to the whole of the process of the sacrifice of the olah .
  24. a regulation carried out several days is counted only once.
  25. * the additional offering ( moussaf ) at the time of the seven days of Souccot account for only one command (although a number different of cows must be offered each day).
  26. Each form of punishment is counted like a positive regulation.
  27. * the Torah orders with the court to apply the capital punishment by lapidation to a blasphemer, an admirer of Moloch, and other sinners. This punishment counts for only one command, although appearing in many different contexts.
