The secondhand trade is the Commerce of Objet S worn, generally of low value. By Métonymie, the term indicates also the Boutique S where this kind of trade is practiced, as well as the popular Foire S generally organized Sundays and bank holidays.
Contrary to the “fairs to all” or “Vacuum-attic S” made up of private individuals, the secondhand trades are demonstrations mainly made up of professionals; in North of France and in Picardy, one meets also the term of “redery” or “annual stock sale”. These demonstrations have been increasingly numerous for a few years, in particular in France where they constitute a true sociological phenomenon. They are particularly numerous in Île-de-France and in the Northern , often gathering a hundred, even a thousand of exhibitors, amateurs (private individuals) or professionals (second-hand dealers and antique dealers). Most important, with approximately: 10000 exhibitors is held each year in the downtown area of Lille during the first weekend of September. This demonstration is known as “mixed”, i.e. it includes/understands at the same time private individuals and professionals.
In France, the very significant development of the vacuum-attics involved a reaction of the professional second-hand dealers and antique dealers who worry about what they call an unfair competition. Indeed, certain private individuals would not be satisfied to sell worn personal objects, but would make a true trade without supporting the loads to which the professionals are fixed.
The private individuals could hitherto take part in vacuum-attics without limitation of time or place, but the law for the economic initiative, known as law Dutreil, voted on July 13rd, 2005, appreciably restricted these possibilities. It indeed modifies the L.310-2 article of the Code of the trade. From now on (or at least after the publication of the decrees on enforcement of a law awaited for the end of the year 2005), the private individuals will be able to take part only in two vacuum-attics per annum and only provided that they have their place of residence (or their second home) in the commune or the intercommunality or the departmental district sits of the demonstration (in the municipal district in Paris and Lyon).
Before even its application, this measurement raises many protests of town councilors or associations which estimate that she will condemn their demonstrations and will thus deprive them of the resources drawn from the hiring from the sites, the entrance fee and publicity. This is why the decree on enforcement of a law of this law is still not appeared with the official journal.
It should be noted that these restrictions do not relate to the sales of objects on Internet.
