See detailed article: the Myths founders of the Israeli policy
Roger Garaudy is author of work entitled myths founders of policy Israeli , which was published in 1995 by the editions the Old crone which was used it only for its own subscribers, then republished in 1996. This work, claiming Antisionisme, is composed of three principal chapters: “Theological myths”, “Myths of the 20th century” and “the political use of the myth” -].
It supports the thesis negationnist of a plot Zionist, which would have invented Shoah to justify the expansionism Israeli, thus denies the genocide made by the Nazis against the Jews, and rejects the theses that the historians admitted since of the decades. It thus adopts the fundamental theses of the negationnism: Hitler would not have given the order of the extermination; the word extermination would be a false translation and indicates in fact the expulsion of the Jews; the Jews were decimated by the Typhus and the crematory ones were used to burn the corpses of the victims of the disease; there would be no reliable witnesses; the crimes of the Allies would be worse than those of the Nazis; the gas chambers would not exist; tortures would have been inflicted to the prisoners Nazis to make them acknowledge the genocide; theory of the Jewish plot, alleged absence of refutation of the theses of the negationnism, material impossibilities related on the Zyklon B and the operation of the crematory ones. The radical antisionism of Roger Garaudy had led it, since 1982, to place on the same plan Sionisme and Nazisme.
The “Garaudy business” is initially revealed by Duck connected in January 1996, followed by some national daily newspapers, involving against him, the deposit of several complaints with Constitution of civil part for dispute of Crime against humanity, racial public slandering and provocation with the racial hate by associations of resistant, deportees and defense organizations of the human rights. Then, the scandal is médiatisé in April 1996, when Roger Garaudy and his lawyer Jacques Vergès, announce the support of the Abbé Pierre, which is excluded from the Licra and is constrained to move away from the media life. Converted with the Islam since the beginning of the years 1980, Roger Garaudy had also received during the lawsuit the support of intellectuals of Arab and Moslem countries.
Roger Garaudy was condemned, on February 27th, 1998 for dispute of crimes against humanity, racial slandering. In its waited, the court stresses that “far from limiting itself to a critic of the Zionism (…) Roger Garaudy devoted himself to a virulent and systematic dispute crimes against the humanity made against the Jewish community”. Rejecting the argument according to which its book would be “antisionist” and not “anti-semite”, the magistrates explain that the author, “although it is defended some, present in the form of a political criticism (…) from Israel what is not that a calling into question of the whole of the Jews”. This judgment was confirmed in call on December 16th, 1998, Garaudy moreover being condemned for provocation to the racial hate. Its appeals was rejected by the court of criminal appeal on September 12th, 2000. Its recourse in front of the European Court of the human rights, founded on the violation of article 10 (freedom of expression) of the European Convention of the Human rights, article 6 (right to a fair trial) of Convention, article 4 of the Protocol No 7 (right not to be judged or punished twice) and articles 9 (freedom of thought, of conscience and religion) and 14 (prohibition of discrimination) of Convention, was declared inadmissible by the Court, the judges European declaring:
- “As the national jurisdictions showed it, that the applicant endorsed the theses negationnists and called into question systematically the crimes against the humanity made by the Nazis towards the Jewish community. deliver, which has as a whole, a character marked negationnist, goes against the fundamental values of Convention, namely justice and peace. (…) No element makes it possible to establish that Mr. Garaudy did not profit from a fair trial. ”
