Robert Faurisson

Robert Faurisson , born the January 25th 1929, is a university French and critical arts person, condemned on several occasions for negationnism.

Lecturer with the Sorbonne, then University lecturer in contemporary literature with the university Lyon II, it is most known of the French partisans of the speech negationnist, denying the existence of the “gas chambers homicides”, of the death camps (which it regards as simple Concentration camps) and, more generally, reality of the Génocide of the Jews made by the Nazis during the Second world war.

Biography

Literature with the negationnism

In 1961, Robert Faurisson in the review Bizarre , published by Jean-Jacques Pauvert, a study of the work of Arthur Rimbaud, under the title has one publishes LU Rimbaud? . At the time of its first edition, the text is signed simple initial RF , the author then wishing to keep anonymity. The thesis of the study, discussed at the time, is to allot to the sonnet “Vowels”, of Rimbaud, an exclusively erotic direction. Ten years later, it presents its thesis of third cycle on Lautréamont, where it intends to show that the Songs of Maldoror are actually a parody. The vision of Faurisson is also discussed, and is seen in particular marked by the critic Pierre Albouy of “intellectual Poujadisme””. Robert Faurisson is especially made know general public in 1979, during the publication of a letter platform sent by him to the daily newspaper Le Monde . The polemic which follows and various threats for its physical safety, led it to leave the station which it occupied with the university Lyon II. It is then affected with remote teaching. It was the subject of several aggressions, including one in 1989 which was worth a fracture of the jaw to him.

Robert Faurisson quickly had the support of Pierre Guillaume. He presented himself several times as a left man of (he adhered besides to the Union atheists, association generally classified on the left) while its contradictors, whose Pierre Vidal-Naquet, regards it as a sympathizer of extreme right-hand side of long time (certain elements of this medium having a tradition of virulent Antisémitisme).

He was condemned on several occasions by French justice, in particular for “dispute of Crime against humanity” under the terms of the Loi Gayssot.

Legal procedures

1981-1998

The first judgment is marked the July 8th 1981. Robert Faurisson is condemned to frank the symbolic system to have declared that “forever ordered Hitler nor allowed that whoever was killed because of its race or its religion”. The sorrow is confirmed in call two years later. This judgment having been published partially in the Dalloz-Sirey collection of the February 3rd 1982, Faurisson attacks in 1983 SA Dalloz in order to obtain damages; the TGI of Paris recognizes the faulty character of not announced cuts and condemns the company defendant to the only publication of the judgment of 1983.

Robert Faurisson is condemned, the April 18th 1991, with a hundred and thousand francs of fine with deferment for “dispute of crime against humanity”, by the 17th Criminal Court of Paris. In a maintenance with the Shock of the month (September 1990), he declared, in particular, that “the myth of the gas chambers is a gredinery” and that he has “excellent reasons not to accept this policy of extermination of the Jews, or with the magic gas chamber, and one will not walk me by truck to gas. ” Patrice Boizeau, director of the publication of monthly magazine, was also condemned to him, with thirty thousand francs of fine and to pay twenty thousand francs of damages to each of eleven associations of former deportees who had constituted civil part. The court also ordered the publication of the judgment in four daily newspapers, at a rate of fifteen thousand francs per newspaper.

The Committee of the human rights of the United Nations estimated, the November 8th 1996, that France had not violated paragraph 3 of article 19 of the international Pacte relating to the civil laws and political by condemning Faurisson on the basis of law Gayssot (Court of Appeal of Paris, December 9th 1992).

He is condemned, the April 27th 1998, with twenty thousand francs of fine for “dispute of crime against humanity”, by the 17th Criminal Court of Paris, to have denied the existence of Shoah in a mail published in the weekly magazine Rivarol the July 12th 1996.

October 12th, 2000

Judgment by the Magistrates' court of Paris of Stephan Khémis, director of the publication of the magazine the History , for refusal of insertion of a right of reply of Faurisson. Confirmed judgment the December 19th 2001 by the Court of Appeal of Paris.

Judgment of July 4th, 2007

The last judgment goes back to it makes following the lodged complaint by MRAP, LICRA and LDH following the remarks made in February 2005 on the Iranian chain Sahar 1. It disputed the existence of an attempt at extermination of the Jews by the Nazi regime, affirmed that the Nazis sought a “territorial solution” consisting in installing the Jews in another country (as the Palestine) so that they are not any more of the “parasites” and allotted to epidemics the deaths people whose corpses appear on photographs.

He recognized that the remarks which were reproached to him expressed the bottom of its thought, but declared that it did not remember if it had actually made these remarks and that he was unaware of that the reproached remarks were intended to be diffused on a television channel by satellite which one can collect in France.

Its lawyer, Eric Delcroix, required of the court to refuse the application of the law Gayssot, whose adoption would constitute a Voie in fact on behalf of the legislator; for him, to recognize the existence of this way in fact, which it brings closer to the ways in fact made by the administration, would not constitute a control of constitutionality of the laws, controls that the French jurisdictions refuse to carry out (it considers it useful to repeat this argumentation in front of several courts, until obtaining win, because it previously succeeded in making draw aside the application, by French justice, of the legislation relating to the control of the foreign publications).

Quoting a declaration of Faurisson, according to which the sorrows pronounced in its opposition were increasingly light, the parquet floor estimated that a sorrow more severe than a fine was necessary, and it required a custodial sentence, with or without deferment. The judgment returned on October 3rd, 2006 condemned it to three months of suspended sentence and 7500 euros of fine.

The July 4th 2007, the 11th room of the Court of Appeal of Paris confirmed the decision of the magistrates' court. It however increased the amount of the damages to thousand euros, against one euro symbolic system in first authority, for each of three civil left associations.

Lawsuit against Robert Badinter

In 2007, it attacks in justice Robert Badinter, estimating that this last, by treating it of “forger of the history” during an emission on Arte, held of the defamatory remarks . At the time of the first day of audience to the Court of Bankruptcy of Paris, on March 12th, Robert Faurisson reaffirmed that “claimed the gas chambers hitlériennes and the alleged genocide of the Jews form a single historical lie. ” With the audience, the public ministry estimated that the judgment of condemnation of Faurisson of 1981 “constitutes an indictment relentless which gave the whole of the attributes of the forger”. The judgment, returned on May 21st, estimates that the judgment of Mr. Faurisson rested “not on considerations morals” but on “the professional responsibility” for the academic who “had tried to support on an alleged critical research in scientific and historical matter his will to deny the sufferings of the victims of the genocide of the Jews, to rehabilitate the Nazi criminals which wanted it and carried out and to thus nourish the provocations with hatred or violence with anti-Jewish character”. By using the word of “forger”, raises the court, Mr. Badinter “thus preserved a perfect moderation in the matter. ” In conclusion, the court débouté Robert Faurisson and condemned it to pour 5000 euros with Robert Badinter under the court fees.

The parquet floor of Paris the July 4th 2007 confirms that it actually filed proceedings against the remarks made in Teheran by Robert Faurisson, in order to determine which exact remarks were reproduced, and on which media diffused in France.
