Problems of the right of telecommunications

The transmission of information is in the middle of the development of the “remote” means of communication. The characteristic of the electronic communications is the existence of networks. This characteristic characterizes these means of communication as all those which preceded it historically and technically. Thus, the development of the telegraph collections, initially, and telephone, then, has the double effect, on the one hand, of being world and, on the other hand, of being presented in the form of various networks. This is why the right of telecommunications has this specificity compared to the other branches of the right of information and the communication to have always been at the same time a right of the contents of information and a right of the data carrier within a mondialized framework. This had as a consequence the internationalization of the telecommunication networks. At the same time, and paradoxically, telecommunications present a national stake extremely. For a long time, telecommunications were the ground of national monopolies. The idea of an influence of the administration was prégnante there. The destructuration of the national monopolies did not remove this influence. The existence of an national administration of regulation of telecommunications testifies some. This administration, ART (Regulatory agency of telecommunications) in 1996, the ARCEP (Regulatory agency of the electronic communications and postal) since 2005, was created pursuant to the Community directives, the Package Telecom.
