Resolution 1636 of the Safety advice of the United Nations

The resolution 1636 of the Safety advice of the United Nations is a adopted resolution the October 31st 2005 unanimously of the members of the council and which aims at obliging the government Syria N to cooperate with the independent international commission which inquires into the assassination of the ex Prime Minister Lebanon board Rafic Hariri the February 14th 2005.

Contents of the resolution

Acting under the terms of chapter VII of the Charter,

  • decides (...) that any person designated by the commission or the Lebanese government like suspect of implication in the preparation, the financing, the organization or the execution of this terrorist act (...) will be subjected to (...)” a prohibition of entry or transit on the territory of all the States” and” a freezing of their funds, financial assets and economic resources.

  • notes the recent declaration by Syria of its intention to cooperate from now on with the commission and awaits from it that it honors this engagement fully.

  • decides that Syria must stop any person in charge or Syrian ordinary citizen that the commission regards as suspect to be implied in (...) this terrorist act, and to completely place them at the disposal of the commission.

  • the commission must have with respect to Syria the same rights and authority that those mentioned in paragraph 3 of the resolution 1595 (2005) (with respect to Lebanon) and Syria must cooperate with it completely and unconditionally.

  • the commission will have the authority to decide the place and the methods of interrogation of persons in charge or Syrian citizens whom she will consider it useful to question.

  • insists that Syria does not interfere into the interior matters of Lebanon, directly or indirectly, abstains from any attempt destabilizing it and scupuleusement respects its sovereignty, its territorial integrity, its unit and its political independence.

  • request at the commission to give to him an account of progress of its investigation, including degree of co-operation received on behalf of the Syrian authorities, from here at December 15th, 2005 or constantly before this date if the commission estimates that the co-operation does not satisfy the requirements of this resolution, so that the Council, if necessary, can consider other measurements.

Reactions

Following the vote, the chief of the Syrian diplomacy, Farouq Al-Shara declared that the co-operation of Syria was already “ complete ” and regrets the vote of such a resolution, which according to him, is based on a report/ratio which does not respect the Présomption of innocence that Syria should have. He has then defendant certain intelligence services Western (American, Spanish and British) not to have prevented them attacks which prepared in Syria. The persons in charge of its countries immediately retorted while being outraged of its remarks.

Under cover of anonymity, a Syrian person in charge declared with a journalist of the AFP: “ the resolution is unjust. Syria considers it regrettable that such a resolution was adopted unanimously. That causes concern and the regret among the Syrians ”.
