Renaud Van Ruymbeke
Renaud Van Ruymbeke , born the August 19th 1952 with Neuilly-sur-Seine, is a Magistrat French, currently with the financial Pôle of the court of Paris.
Wire of Andre Van Ruymbeke, former director of the dairy Union Norman (ULN), it carried out the instruction of several politico-financial businesses, such as for example the Affaire Urba, the Affaire of the frigates of Taiwan and, initially, the Affaire Clearstream 2 (See Clearstream). Renaud Van Ruymbeke is the examining magistrate of the Affaire of the frigates of Taiwan.
For this reason, it received several mails anonymous of a corbel seeking to draw its attention to several political personalities and/or economic, starting the Affaire Clearstream 2 (or business of the Corbel).
Business Clearstream 2 (or business of the Corbel)
Examining magistrate of the business of the frigates of Taiwan, Renaud Van Ruymbeke was also implied in spite of him in the Affaire Clearstream 2 (or business of the Corbel).
After a first letter of received denunciation on May 3rd, 2004, Renaud Van Ruymbeke makes challenge the vice-president of EADS Philippe Delmas with Toulouse, in full inauguration by Jean-Pierre Raffarin of a new assembly line of the Airbus A380. He will quickly be cleared.
In June 2004, Renaud Van Ruymbeke receives then a cédérom containing 16.121 Clearstream accounts and a second letter entitled “the ball of the villains”. This letter contains a list of 895 accounts allegedly closed by Clearstream. Appear six accounts of Banca Populare di Sondrio, in Italy whose Stephan Bocsa and Paul de Nagy would be titular. It is about a coarse allusion to Nicolas Sarkozy, whose complete name is Sarkozy de Nagy Bocsa, and whose second and third first names are Stephan and Paul. Names of political personalities like “J. - P. Chevènement”, “A. Madelin”, “D. Strauss-Kahn” are associated.
At the end of June 2004, the Point publishes an article on “the business of State which makes tremble all the political community” and quotes “ministers”, without name. Renaud Van Ruymbeke is also consolidated by his first checks: certain account numbers, like those of BNP, are authentic. International letters rogatories are addressed abroad, in particular in Sondrio, in Italy, via the financial parquet floor of Milan. The Italian answer arrives only in November 2005: all is negative.
As of the end 2004, Renaud Van Ruymbeke knows that it was the subject of a handling. The names of personalities were added with the listings of Clearstream. The Preliminary investigation open on the other accounts is classified without continuation in May 2005. A procedure is launched for libelous denunciation. It is the beginning of the Affaire Clearstream 2, which will become a business of State only in spring 2006 when Nicolas Sarkozy goes civil part, convinced of a plot warped by the chiraco-villepinists.
At the beginning of May 2006, it is established that Jean-Louis Gergorin made contact at the end of April 2006 judge Renaud Van Ruymbeke by his lawyer Thibault de Montbrial. They secretly meet on April 30th, 2004 and of the anonymous documents are given to the judge on May 5th, 2006.
Blamed by the Minister of Justice
May 12th, 2006, the Minister for Justice Pascal Clément asked Renaud Chazal de Mauriac to collect the explanations of judge Van Ruymbeke on the Affaire Clearstream 2 and on May 15th, 2006, it deferred the promotion of the judge at the position of president of room to the Court of Appeal of Paris. May 18th, 2006, judge Van Ruymbeke was heard by the General inspection of the services also seized by the Minister of Justice, Pascal Clément.
In his report/ratio made public at the end of January 2007, the General inspection of the legal services, which in June 2006 had cleared of any fault the Juge Burgaud in the Affaire of Outreau, is hard for Van Ruymbeke in the Affaire Clearstream 2. The IGSJ retains three objections likely to constitute “ a failure with the duties of its state of magistrate and his duty of honesty ”:
- It should not have heard, except procedure, Jean-Louis Gergorin, the former vice-president of EADS.
- It should have informed his/her colleagues Henri Pons and Jean-Marie d' Huy, seized of the Affaire Clearstream 2, that Jean-Louis Gergorin was the corbel of the Affaire of the frigates of Taiwan.
- It should not have shown parts of its procedure to another actor of the business, the data processing specialist Florian Bourges. An episode that Renaud Van Ruymbeke always disputed.
According to the IGSJ, this behavior suspecter the objectivity of the magistrates would be of “ natural to make”. And if the Inspection concedes that Renaud Van Ruymbeke acted by only concern of the truth, and that it lent his contest to no operation, the report/ratio does not underline that it dismounted itself, as of the autumn 2004, the handling which constituted the falsified listings.
At the beginning of February 2007, it Minister of Justice Pascal Clément returned the magistrate in front of the Superior council of the magistrature (CSM) by a mail stating that the magistrate had " missed with the obligations of prudence and rigor " , of " honesty " and of " professional discretion ". His report/ratio made public on August 6th, 2007 is measured more than the letter of sasine of the minister Pascal Clément. The CSM should sit as a disciplinary board in September 2007. The rrapport of the CSM devotes three pages out of nineteen to point out the conditions of the investigation " particularly difficult " Business of the frigates of Taiwan, during which the judge is " run up against against various recoveries with the Secret defense ".
