Rachida Dati
Rachida Dati , born the November 27th 1965 with Saint-Remy cheese in Saône-et-Loire (Burgundy), is a French political woman. After having been spokesperson of the candidate Nicolas Sarkozy at the time of the French presidential election of 2007, it is named Ministre for Justice, Minister of Justice of the government Francois Fillon and is renewed in the government Francois Fillon 2 on June 19th, 2007.
Rachida Dati is the first personality resulting from a family of Maghrebian immigrants to occupy station such a high in a French government.
Biography
Youth and studies
Girl of Mbark Dati, mason Morocco Ain arrived to France in 1963 and of a Algeria nne, second of a family of eleven children (seven girls and four boys), it passes her childhood to Châlon-sur-saône, in the district of the Meadow-Saint-Jean. Its schooling proceeds in a catholic private school held by Carmélites then at the Mathias public lycée; it obtains its baccalaureat in 1983.Without disavowing its Maghrebian origins, Rachida Dati insists today to relativize their importance in his personal construction. While evoking its Arab family roots, it makes a point of highlighting which it initially regards as girl of France, resulting from modest milieu.
To finance its studies, Rachida Dati works, in particular as saleswoman with the door-to-door or Assistance-looking after E. After an attempt missed engaging in studies of medicine, it follows a university course to obtain a DEUG (with the Université of Dijon) then a control in economic scenes (with Paris II). In 1992, with a financing of Matra, it follows the courses of MBA of HEC to the Institute of higher learning of the businesses (ISA) which it leaves in May 1993, without obtaining the diploma, a private problem from it preventing it from following the last seminar there. Rachida Dati is unmarried today. She has, in August 1992, contracted marriage with a man “with whom avai nothing to divide”. In December of the same year, she asks for the cancellation of this union, which she will obtain from justice in 1995.
Professional path
In 1987, it becomes in charge of study (training, while continuing higher learning in economic scenes and business management. After a meeting with Jean-Luc Lagardere in 1990, it enters to the direction of the To that the of Matra communication, then in 1993 one year passes to London, near Jacques Attali with BERD, always in the audit. Political career
In December 2002, it becomes adviser of Nicolas Sarkozy, for which, it works on the bill on the “prevention of the delinquency” to the ministry for the Interior. It is named adviser technical in April 2004 with the cabinet of Nicolas Sarkozy, Minister for the economy, finances and industry. Between January and June 2005, is executive vice president of the services of the general advice of the Hauts-de-Seine (after one month as a territorial administrator, it is registered with the UMP in December 2006. It is named the evening of Sunday January 14th 2007 spokesperson of Nicolas Sarkozy (in duet with Xavier Bertrand), indicated the same candidate day of the UMP party for the French presidential election of 2007.She announces on November 7th, 2007 that she will be the candidate with the French municipal elections of 2008 invested by the UMP in the 7th district of Paris, district politically acquired with the right-hand side.
Rachida Dati is in addition member of the Institut Montaigne, of the club the Century, cofondatrice of the Club XXIe Siècle (which it since had to leave) and founder of Bleu Blanc Rouge association.
Difficult beginnings
During its first months with the ministry, she is confronted with a series of resignations in her cabinet, initially her principal private secretary, Michel Dobkine, the July 6th 2007, is followed of three other members on July 10th, then her two technical adviser and principal private secretary. The chancellery announces on September 5th, a new cabinet of eighteen members, more opened with the top-civils servant, and including/understanding François Guéant, wire of the general secretary of the Elysium.
At the same time, the legal contentions of two of his/her brothers are revealed in the press.
At this occasion, some estimate that it is victim, because of consonance of its patronym, of an unjust campaign , and that it pay, as of its arrival, the full price to be the first nobody resulting from Maghrebian immigration to reach such a governmental responsibility . Others call upon, on the other hand, the breakable or authoritative character of the minister.
Its competences are also questioned: Philippe Bilger, Prosecuting attorney close the Court of Appeal of Paris, considers, for example, that the minister “was not chosen by the president for his competence” but because it “is a woman, a symbol and the pet of the presidential couple”, and that it does not have enough experiment to direct a ministry d´une such importance. The weekly magazine the Express train raises that the file for its admission without contest at the National school of the Magistrature mentions a diploma of MBA (Master off Business Administration) delivered by the ISA-HEC which it does not have in fact not obtained. Following denial, the Canard Enchaîné publishes, in its edition of October 31st, 2007, an extract of the CV of entry with the ENM in which, according to the newspaper, the minister did not say anything expressly but cultivated an ambiguity which could induce certain magistrates or senior officials in error.
Law on the repetition
One month after its nomination, it presents to the Senate the first text of the government on the repetition of the minors. The bill on the repetition, which consists in founding minimal sorrows for the recidivists and excludes, in certain cases, the excuse of minority for the minors multirecidivists of more than 16 years, which belonged to the presidential project of Nicolas Sarkozy was adopted on July 27th, 2007. It was defended by Rachida Dati, however this one made polemic, certain judges criticizing the sorrows floor as being contrary with the traditional vision of French justice and in particular with the principle of the individuality of the sorrows, resulting in increasing the incarceration population.
Independent general inspector
July 9th, 2007, Rachida Dati proposes the creation of a station of “independent general inspector”, which will have the role of checking that the basic rights of the prisoners are respected strictly. It will be able in particular to denounce all the inhuman treatments. July 29th, 2007, Rachida Dati goes in Great Britain in order to meet the inspector as a chief of the British prisons, Anne Owers, equivalence of the post of independent general inspector whom she wants to create, Rachida Dati being said “consolidated in the need for the creation of this station” after the discussions with Anne Owers.
Reform legal chart
Considering that a very large distant jurisdiction is more economic and more effective than several small courts close to justiciable, and also “because it is a presidential promise”, Mrs. Dati announces on June 25th, 2007 a reform of the legal Carte which should come into effect on January 1st, 2008. This one consists in the suppression and the transfer of a great number of courts towards more important seats. The building sites of enlarging of the preserved courts, already strongly overloaded, so that they can take again their businesses, their personnel and their files, do not seem not envisaged. On the other hand, of the “houses of public service of justice and the right” should also be built, in particular in the suburbs: the “citizens” will find there services of conciliation, civil and penal mediation, legal consultation and an one-stop shopping of the clerk's office. Although the project is not final and that the list published by newspapers are disputed, the list of the jurisdictions removed currently includes/understands 7 cours d' call (Agen, Bourges (abandoned), Grenoble, Metz (abandoned), Nice, Nimes, Pau, Riom), 23 of the 181 Courts of Bankruptcy (Alès, Bergerac, Dinan, Libourne, Mende, Millau, Moulins, Morlaix, Saumur, Thionville, etc.), more 176 of the 473 magistrates' courts, plus 63 of the 271 councils of the prudhommes, plus 69 of the 191 bankruptcy courts. No new jurisdiction is created, but open audiences are envisaged in the old courts of the cities where jurisdictions will have been removed. It is nothing known as on the destination the splendid old buildings, often classified historic building, which had been built for the removed jurisdictions.This reform of the legal chart, which is not the first since that of Michel Debré in 1958 since in 1975 the Court of Appeal of Versailles and the Courts of Bankruptcy of Bobigny, Nanterre, and Creteil had been created to discharge the Law courts of Paris, is however most important since that of the French revolution.
These projects cause a strong protest movement, initially among the justiciable ones to the areas concerned, then among magistrates, clerks and personnel of the legal services, lawyers and town councilors, all left confused.
The role of the parquet floor
An important polemic develops in 2007 on the bonds between the Chancellery and the parquet floors.It crystallizes in September - October 2007 around the refusal of change of the Public prosecutor of Agen, Bernard Blais, with the Court of appeal in eight month of its retirement, the minister maintaining his decision in spite of the unfavorable opinion given by the Superior council of the magistrature (CSM).
Rachida Dati renews a third of the public prosecutors by naming ten new prosecutors including five women on November 15th, 2007. Before that, this body comprised 2 women out of 35, whereas they account for approximately 50% of manpower of the magistrates. The historian Alain Bancaud estimates that the width of such a renewal was not seen since the end of the second world war.
