Promise of contract

In contract law French, a promise of contract is a contract which obliges its debtor (or promising) to promise a contract with the creditor (or recipient) of this promise.

The promise of contract is a Avant-contrat: it is conceived only in the objective to contract later on.

There exist two types of promise of contract:

  • the unilateral promise to contract is a contract by which promising commits itself towards the recipient concluding a future contract whose conditions are already given, if this last requires of him within a given time said the time of lifting of option .
  • the synallagmatic promise to contract is a contract by which two or several people urge one towards the other to conclude a future given contract.
