Program local habitat
The local program of the habitat (PLH) is, in France, the principal device as regards housing policy at the local level. It is the essential document of observation, definition and programming of the investments and the actions as regards housing policy on a territory scale. Relevant level retained by the law, it is with the public corporations of inter-commune co-operation to work out the PLH. It lays down objectives and decides actions aiming at meeting the needs for residences and Urban renewal. It is established for one six years period. The PLH relates to all the types of habitat, but aims in particular at answering the objective of Social diversity by supporting a distribution balanced of the social housing on all the territory of the public corporation of inter-commune co-operation (EPCI).
The local program of the habitat draws up the inventory of fixtures of the park of residences existing, private as public, and defines the solutions adapted to each component of sound Territoire. This document must be compatible with the main trends laid down by the SCOT Schéma of territorial coherence (SCOT). It takes into account the Plan of urban displacements (PDU), and the Projet of installation and sustainable development (PADD). On the other hand, the Local plan of town planning (RAINED) must be compatible with the stipulations of the PLH. The code of construction and the dwelling specifies (L302-1 articles and following, + lawful part) nature, the principles general and the mode of adoption of the PLH.
The PLH were created by the law n°83-8 of January 7th, 1983 (Article 76 and following) then reinforced by the law of orientation for city (LOV) of July 13rd 1991. The Loi of August 13rd, 2004 will make this instrument the central element of the device “habitat” of the territorial collectivities. With the law nº 2006-872 of the bearing July 13rd, 2006 National engagement for housing, a PLH is obligatorily elaborate in all the Communautés of qualified communes as regards habitat of more than 50.000 inhabitants including/understanding at least a common of more than 15.000 inhabitants, in all the Communautés of agglomeration and all the Urban communities.
PLH and intercommunality
Since 2004, it exclusively returns with the EPCI to work out the PLH. With such a document, the EPCI is the organizing authority of the policies of the habitat in the dash of decentralization operated by the legislator in 2004.The realization of a PLH on the level of a grouping of common has consequences on the implementation of the social quotas of housing fixed by the Loi SRU. Article 55 of this law, listed in the L302-8 article of the Code of construction and the habitat, specifies indeed that the objective of realization of 20% of social housing, which applies normally to the level of a commune, can be carried out on the level of a grouping of communes when this one established a local program of the habitat. The existence of a PLH thus makes it possible EPCI to concentrate in its hands the whole of the vectors of intervention as regards housing.
