The residence permit private life and family or chart VPF in France is an authorization of stay for foreigners created by the law of May 11th, 1998 known as law RESEDA (or elative law R with the E ntrée and the S éjour of the E trangers and with the D roit of has sile).
This residence permit, one year renewable, gives right to the exercise of an community activity.
This title is especially allotted to the members of family of French not being entitled to the resident's card, like with the candidates with the residence in France with the reason for personal and family bonds .
The residence permit " Private life and familiale" can be granted to any person related to a français/à a Frenchwoman by a PACS after one year of common life.
The members of family of French seeing itself allotting a chart VPF who were only 12.095 in 1999, were 53.588 in 2004. Let us note that on the other hand, the number of members of family of French seeing itself giving the resident's card crumbled of 21.020 in 2002 to 8.037 in 2004. For 81%, these entering are couple.
Among the members of family of French, the Africans are strongly majority, 73,8% in 2004, and 52,2% for only the Maghrebians.
As for the titular foreigners of a chart VPF for " personal bonds and familiaux" , they are increasingly numerous also: 13.989 in 2004, including African 62,6%, against 3.314 in 1999. According to the report/ratio of the DPM (Direction of the population and migrations of the French ministry of employment), the allotment procedure of this residence permit is connected in this case with a regularization with the current.
According to the High council with Integration (statistical Observatory of immigration and integration), in the facts, three reasons are dominating (more than 95% of the total) among the foreigners obtaining a chart VPF for " personal bonds and familiaux" : they are the minors having their main home in France since the ten years age, then foreigners justifying of their main home in France since at least 10 years, or 15 years if they were students, and finally, mainly foreigners whose the personal and family bonds are such as the refusal to authorize the stay would conflict with the right to the respect of the private life and family disproportionate taking into consideration reason of refusal (article 12 (a) 7).
