In 2002, the incarceration population with the the United States counted nearly 2,1 million people.

Organization

The Federal government and each State lay out of their clean “criminal Law positive” (indexing the Infraction S and the means of Défense) and of their clean “Penal procedure” (determining the various stages of the penal legal proceedings, of the arrest to the committal for trial, the Condamnation, the grounds for appeal and the exit of Prison).

Minors in prison

According to a study of Human Rights Watch (HRW) and Amnesty International (AI) published the October 12th 2005, at least 2.225 prisoners who were minors at the time of the facts for which they were condemned, purge a custodial sentence with life without possibility of Release on parole. This element is in contradiction with the Convention of UNO on the Droits of the child, Convention which is not ratified by the United States.

According to this same study, it is in the United States that are held with life the most people without possibility of Release on parole for Crime S made whereas they were minors. Only three other countries, among the 154 where the study could be carried out, authorize this type of Condamnation, it are: the South Africa, the Tanzania and Israel. It is in Virginia, Louisiana and with the Michigan which one would find the strongest rates of judgments of this type. Certain prisoners were condemned for crimes less serious than of the Meurtre S.

World network

The the United States would have also a world network of prisons for supposed Terroriste S, managed by the the CIA, and which enables them to escape their clean Législation as regards respect from the prisoners. The business was revealed by the American newspaper The Washington Post the November 2nd 2005 which announces that about thirty people, suspected of being related to the network Al-Qaïda, would be thus held secretly in eight countries (as for example the Thailand) which brought all a denial to these allegations.

Statistics

The number of the prisoners strongly increased as from the years 1980, after the coming into effect of the anti-drug laws which imposed incompressible minimal custodial sentences. In 2004,25% of the prisoners of the country were it for traffic or drug taking
