Authority and jurisdiction

The President of the Republic of Croatia:
  1. represents the Republic of Croatia in residence and abroad;

  2. is guaranteeing regular and harmonious operation, stability of the government of the State;
  3. is responsible for the defense of independence and the territorial integrity for the Republic of Croatia;
  4. solemnly swears honesty with the Constitution in front of the President of the Constitutional court;
  5. calls with elections for the Croatian Parliament and gathers the elected officials for the first session of the Parliament;
  6. calls with referenda, in conformity with the Constitution;
  7. entrusts the responsibility to form a new government with the deputy who, after distribution of the seats to the Parliament and consultations, profits from the confidence of the majority of his pars;
  8. grants graces;
  9. delivers the decorations and other rewards mentioned by the law;
  10. cooperates with the government in the formulation and the execution of the foreign politics;
  11. decides establishment of diplomatic relations and consular establishments of the Republic of Croatia abroad, on a proposal from the government and with the against-signature of the Prime Minister;
  12. names and revokes the diplomatic representatives of the Republic of Croatia with the preliminary against-signature of the Prime Minister, on a proposal from the government and after opinion of the diplomatic commission of the Parliament;
  13. receives the letters of accreditation and letters of revocation of the foreign diplomatic representatives;
  14. names and revokes the military commanders;
  15. can declare the war and conclude peace following a decision from the Parliament;
  16. can, with the against-signature of the Prime Minister, to order the deployment of the armed forces even if a war were not declared, in the event of immediate threat with independence, the unit and the existence of the State;
  17. can publish decrees with the force of law following a delegation of powers of the Parliament. If the Croatian Parliament is not in session, the President of the Republic is authorized to settle all the related questions with the state of war by decrees having the force of law;
  18. issues with the force of law, on a proposal from the Prime Minister and with its against-signature, in the event of immediate threat with independence, the unit and the existence of the Republic of Croatia, or if the governmental apparatus cannot fulfill its constitutional obligations;
  19. can join together the government for a council, chair this council in the event of war or immediate threat independence, the unit and the existence of the Republic of Croatia;
  20. can propose with the government to hold a session and to establish the day order of it;
  21. can be present at the Council of Ministers and take share with the deliberations;
  22. Co-directs the operations of the security services with the government;
  23. dissolves the Parliament if this last made pass a motion of censure against government, or if it did not approve the budget of the State 120 days after it was proposed. Dissolution has place on a proposal from the government and with against-signature of the Prime Minister, and consultations with the repésentants of the parliamentary groups;
  24. can restrict individual freedoms and the rights guarantis by the Constitution during a war, an immediate threat with independence and the unit of the State, a natural disaster, if the Croatian Parliament is in the incapacity to meet, on a proposal from the government and with the against-signature of the Prime Minister;
  25. gathers the emergency sessions of the Parliament;
  26. can call a referendum on a proposal for an amendment of the Constitution or any other subject which he considers being of importance for independence, the unit and the existence of the Republic of Croatia, on a proposal from the government and with the against-signature of the Prime Minister;
  27. promulgates the laws within 8 day after they are voted by the Parliament;
  28. can seize the Constitutional court in connection with the constitutional validity of certain laws.

History

Immediately after the first elections multi-party of Croatia, the station of President of the Republic of Croatia was founded after amendment of the Constitution of the Socialist République of Croatia (then member of the Federal republic of Yugoslavia) at the summer 1990. The President of the Socialist Republic of Croatia Franjo Tudjman is named President of the Republic of Croatia.

The new constitution was approved the December 22nd 1990.
