Policy of Kampuchea

The Kampuchea is a constitutional Monarchie with multi-party parliamentary representation. The Prime Minister is the chief of the government, which exerts the executive power, while the legislative power is shared between the government and the two rooms of the Parliament.

Executive power

The Prime Minister is resulting from the majority party to the National Assembly. He is named by the king, on recommendation of the president and the vice-president of the assembly. The Prime Minister must then collect a vote of confidence of the assembly, before naming the ministers who will compose his government.

Current the Prime Minister, Hun Sen, is in station since the elections of 1998, which took place one year after the coup d'etat strapping of the CP with Phnom Penh which reversed the Prime Minister of then, the prince Norodom Ranariddh, president of FUNCINPEC. The elections of 1998 were criticized by the international community because of the lack of transparency.

Legislative power

The legislative power is exerted by a bicameral Parliament:

  • the National Assembly counts 123 members elected for a five years mandate by the vote proportional;
  • the Senate counts 61 members, of which 2 are named by the king, 2 are elected by the National Assembly and 57 are elected by the people; the senators are elected for a five years mandate.

The laws adopted by the Parliament are transmitted to the king for approval. This stage revĂȘt a character symbolic system since, not having right to veto, the king cannot refuse to give his agreement.

The National Assembly has the capacity to revoke the Prime Minister following a vote of distrust having to collect two thirds of the voices.

The deputies elect a president and two vice-presidents at the beginning of each session.

The minimum age is 18 years to be entitled to vote, 25 years to be eligible.

Judicial power

The Supreme council of the magistrature holds the judicial power in last authority. Although the constitution guarantees the independence of the judicial power, Human Rights Watch denounced the fact that it serf often of auxiliary to the executive to reduce the leaders of the opposition to silence.

Monarchy

Kampuchea is a constitutional Monarchie, the king, officially Head of the State, reigns but does not direct the country.

Contrary to the majority of monarchies, the Kampuchean crown is not transmitted obligatorily by heredity. The new king is appointed by the royal Conseil of the throne, is consisted of the president of the National Assembly, the Prime Minister, the chiefs of the orders Mohanikay and Thammayut and the vice-presidents of the National Assembly. The royal Council meets in the week following the death or the abdication of the king to indicate new among candidates of royal ascent.
