Police court (France)

The police court is a penal jurisdiction French which judges the Contravention S. the more serious Infraction S (called Délit S) are judged by a Magistrates' court.

Composition

The police court sits at the Magistrates' court and is composed of a Juge and a Greffier.

For its part, the public ministry is represented by the Public prosecutor or one of its substitutes in the case of the infringments of fifth class. The infringments of the first 4 classes are carried in front of the Juridiction of proximity, and either in front of the police court, since 2005.

Competence

Competence rations materiæ (at a rate of the matter)

The police court knows infringments: exclusion of the punished infringements of a sorrow of imprisonment and sorrows of fines higher than 3.000 euros, even 4.000 euros (Article of the Criminal procedure code)

Competence rations loci (at a rate of the place)

The police court will be able to know infringements of which it is in the spring:
  • of the place of commission or observation of the infringement;
  • of the residence of the defendant;
  • premises of the undertaking holder of a vehicle blamed;
