" To advise State of Charles VI, was elected archbishop of Lyon about 1339 (there was certainly error of copy: 1389 should be read, and which more is, it is probably about Charles V. NDR), after the death of Jean de Talaru who had succeeded Charles d' Alençon. The long ones and scandalous contentions took place under its episcopate, about the administration of justice in the city and baronnie of Lyon. Letters patent of April 3rd, 1393 having authorized it to drive out city and palate of Roanne the officers of the king, Philippe de Thurey made put these letters at execution by one named Givry. This one, preceded by several ecclesiastics carrying of the hand lanterns, had gone to the hotel of Roanne and had expelled the seneshal of it. He had opened the prisons with two criminals, removed room of the pleadings the table of the royal decrees, allowed one named Cartula to go up to move back on an ass and to trail in the streets, by shouting " all is gained, we do not have more king! " , a sign where the weapons of the king were painted. Complaint was deposited at the Parliament of Paris which, by stop of October 5th, 1394, broke the letters patent of April 5th, 1393, punishes Givry and Catula, and condemned the archbishop to pay damages with the officers of the king, who were immediately restored. In spite of this stop, Philippe de Thurey disturbed even more once royal officers in the exercise of their functions. In 1409, it attended the council of Pisa. The following year, it made the relevation of the body of Irenee saint, Episode saint and Alexandre saint. He died on November 28th, 1415 and had as a successor Amédée de Talaru." A.P. (A. In 1415, Philippe de Thurey names abbot of Savigny one of his own nephews (let us note that the monks having refused it, the archbishop excommunicated all the monks…)" J. Beyssac: Provosts of Fourvière, pp. 131-161
Book of Beyssac, one will retain that pH. T, in its will written the 8/27/1412, bequeaths to his/her Girard brother all that it had received from his family. The original of this will written in low-Latin on a parchment is visible with the departmental records of the Rhone, Montée of the Carmelite friars. One will find the extract of the will below (9 typed pages….) relating to it, as well as an approximate translation:
(33) “Item dat idem Dominus testator atque legate nobili and potenti viro domino Gerardo de Thureyo militi fratri suo carissimo omnia bona sweated ipsius Domini testatori paterna and materna, ac omnia the quacumque Jura eidem Domini testatoris in eisdem profits competentia of caused, and in eisdem profits dictum suum fratrum hoeredem suum facit ipse Dominus testator and instituit, and ore suo landlord nominat ac ess vult. (33) “And the Lord testator gives and bequeaths to noble and powerful man the lord Gerard de Thurey, his very dear brother knight, all the goods of the Lord Testator of paternal and maternal origin and all the rights of this same Lord testator on these same goods, in some competence and causes that it is; and the Lord made testator himself and institutes his above-named brother like his heir to these same goods, and names it its own mouth and wants that it is thus. However, so that this same lord Gerard his brother cannot nor wants in no manner or by any legal means to penetrate, seek to obtain from advantage or to disturb the distribution of the other movable goods of the Lord testator himself and real assets or to acquire by him Seigneur testator and particularly what milked at the house of the Lord testator himself located in the cloister of Jean Saint of Lyon, as well as the house of the same Lord testator called Rivoyre mentioned above its house located beside its true and legitimate close goods; If his/her brother himself or his sons would like to claim or to go against the will and the provisions thus stated of the same Lord testator (because it is not any more), in this case, the Lord testator himself, which had bequeathed and given these same goods to his/her aforesaid brother, the Lord testator gives them and bequeaths them to perpetuity with the very worthy aforesaid men, his very expensive brothers and companions the senior, and the chaplain current of the aforesaid the church of Lyon and which were it of its time, and of the same the Lord testator do them and institutes them heirs to these goods, them which it names of his own mouth, and wants that, thus interposing, the senior and the chaplain of the lord himself are held to defend and respect, carry out and make respect this ultimate will, with the proper expenses and costs of these lords senior and chaplain. ”
That one can translate into good French: “Me, Philippe de Thurey, I bequeath to my brother Gerard de Thurey all the goods which come me from dad and mom. If it were warned to want to dispute my will, these goods would be immediately allotted to the senior and to the chaplain, with their own expenses. ” What was to encourage each part to respect the wills of the late one.
