Payment 1830/2003/CE
The payment 1830/2003/CE of the European Union relates to the Traçabilité food genetically modified Organismes and their derivatives for human or animal consumption.
Object of the payment
The payment n°1830/2003/CE of the European Parliament and the Council of September 22nd, 2003 concerning the traceability and the labelling of the genetically modified Organizations and the traceability of the intended products to the human or animal consumption products starting from genetically modified Organizations, and modifying the Directive 2001/18/CE, is applicable to the operators since April 18th, 2004.
Obligation of traceability introduced into this applicable payment since April 18th, 2004 .permet to trace the advance of GMO throughout the line production and of distribution with for main objective the reliability of labelling. It founds the foodstuffs and the feedingstuffs, the labelling known as “of production” for the food products, independently of the presence of DNA or proteins resulting from the genetic modification in the end product. Thus, the conformity of the products could be checked after examination of the documents provided to the title of the traceability, in particular for the products for which an analytical research is impossible.
Field of application of the payment
The Field of application of this payment is broad since it aims:

all GMO, except for the drugs of human and veterinary use. the obligation of traceability thus applies to the genetically modified seeds, with GMO intended for the food or industrial transformation (for example, cotton for textile industry, unauthorized to date), with the food products and feedingstuffs containing or consistent in GMO (for example, Maïs soft or soya beans);
- products obtained starting from GMO , still called derived from GMO) intended for the human or animal consumption: food food products, ingredients and feedingstuffs (for example, lecithin of soya and corn gluten feed), including the additives and the flavors.
In order to guarantee the coherence of the device, the payment envisages an exemption with the obligation of traceability to the same threshold and according to the same criteria as for the provisions of labelling: the food products, ingredients and feedingstuffs containing in a fortuitous way less than 0,9% of material transgenic are thus exempted of traceability since they are not subjected to the obligation of labelling.
Methods of the traceability
The person in charge of the marketing transmits in writing to the person who receives the product information according to which the product in question contains GMO. It is not envisaged of specific mention to transmit this information.
Parallel to this general information in comparison with the presence of GMO, the operator must transmit the single identifiers corresponding to GMO present in the product. They are alphanumeric codes which are specific for each GMO and whose methods of attribution were defined in the international level and recoveries at community level by the payment n°65/2004/CE: for example, the single identifier of the Maïs Bt11 is SYN-BTØ11-1.
Case of mixed harvests
When harvests coming from various farmers are mixed, on the level of the storage bins for example, it is not always possible to know which are GMO indeed present when the contents of the silo are then split as boozers to be sold to various operators.
Thus, for example, whereas an initial batch can be made up of a mixture of Maïs Mon810, Bt176 and T25, it is possible that under batch only Maïs Bt176 contains insofar as the initial batch is not homogeneous. In order to take into account this case of figure and only for the intended products with being transformed or those which are used directly like foodstuffs or feedingstuffs, the operator is not held to identify GMO indeed present in the product but can transmit the list of GMO used to constitute the initial mixture, accompanied by a declaration indicating the destination of the product (transformation or use in food).
Additional provisions of labelling
Parallel to the obligation of traceability, the payment n°1830/2003/CE envisages complementary provisions of labelling. In particular, for the prepackaged genetically modified products nonfood which concern the Directive 2001/18/CE, the mentions “ this product contains GMO ” or “ this product contains genetically modified organizations ” must be reproduced on a label. It should be noted that the provisions of labelling for the foodstuffs and feedingstuffs are defined in the Règlement 1829/2003/CE.
