Papinien

Aemilius Papinianus (142 - 212), in French Papinien , was a famous lawyer of the ancient Rome, magister libellorum and, after the death of Gaius Fulvius Plautianus in 205, Praetorian prefect.

Life

One knows little thing about the life of Papinien. It was perhaps Syrien of birth, because it passes to have been relative of the second woman of Septime Sévère, Julia Domna. A doubtful passage of the Histoire Auguste affirms that it followed the lessons of right of Scaevola (Quintus Cervidius Scaevola) with Sévère like school-fellow.

Papinien was a close friend of the emperor Sevère and accompanied it in Brittany. Before dying, the emperor entrusted to him his two sons Caracalla and Geta. Papinien tried to maintain peace between the two brothers, but without better result than to reinforce the hatred of Caracalla. He perishes victim of this hatred in the general massacre of the friends of Geta which followed the fratricide of 212. According to the article of Encyclopædia Britannica of 1911, the details of died of Papinien “are variously reported, and underwent a legendary embellishment. ”

Its production not very bulky is compared with that of other lawyers such as Ulpien or Paul. Among the principal works of Papinien, one will note the Quaestiones in 37 pounds (written before 198), the Responsa (written between 204 and its death), the Definitiones and a treaty Of adulteriis .

Legislation

In the Loi of the quotations (426) it is put, with Gaïus, Paul, Modestinus and Ulpien, with the row of the five lawyers whose preserved opinions were regarded as decisive. These five lawyers are also quoted like primary sources of the Code of Théodose II and of the Code of Justinien. The opinion of Papinien was to prevail if the four others diverged.
