Pact preferably

In contract law French, the pact preferably is a type of Avant-contrat according to which a person engages towards another who accepts this pact, not concluding with a third a contract determined before to have proposed the conclusion in the same conditions of it to him.

It is indeed a Contrat, since there must necessarily be a agreement of wills. The obligation of the debtor consists of an obligation to propose an offer to contract. On the other hand, the creditor of a pact preferably (its “recipient”) is not held to accept this offer and can thus refuse it. It is thus only about a Unilateral contract.
