Opposability of the contract to the thirds
In Droit of the obligations, the opposability of the contract to the thirds is a principle according to which the Contrat creates a legal situation that the thirds cannot be unaware of and that they must even respect as a Fait legal. A contract is supposed to harm the thirds and to profit to them only in cases legally given.
The parts can oppose the contract to the thirds
The third should nothing make which would undermine the good execution of the contract. If it does it despite everything, its criminal Responsabilité will be committed.
The thirds can oppose the contract to the parts
According to a recent jurisprudence of the Court of appeal, the failure of a part to its contractual obligation is analyzed, with respect to a third which underwent a damage of it, like a criminal Faute. A third can also oppose contract to the parts to escape a situation legal to which it would be if not held.
