Mike Diana

Mike Diana is an author of Cartoon American underground . He is the first artist to be condemned for Obscénité to the United States.

At the beginning of the Years 1990, within the framework of an investigation into a murder in Florida, a police officer, who had not found as incriminating evidence that a number of the comic-book Boiled angel questioned its young author, Mike Diana, and even carried out on him a blood sample. The culprit of this murder (without relationship with the cartoon) ended up being stopped, but the police officer started to collect the cartoons of Mike Diana, of which it found particularly the topics disturbing, to send them to the prosecutor of Florida. The assistant of this last ended up meaning with the artist whom he was accused for obscenity, as an editor, who distributer and promoter of these works.

Diana contacted the association Comic Book Legal Defense Fund which provided him lawyers. He quickly lost his employment like maintenance hand of an elementary school. After a fast lawsuit, Diana is condemned to three one-year suspended sentences, 3000 dollars of fine, 1248 work hours of general interest, prohibition to come into contact with minors of less than 18 years, a psychiatric evaluation (that Mike Diana could not pay, because the doctor invoiced twelve work hours: two hours of discussion and ten hours with reading the cartoons of the author, that is to say on the whole 1200 dollars) and prohibition to have or produce “material obscene”.
