Career
Nomination at the Supreme court
Rothstein one of three canditats was recommended to be named at the Supreme court of Canada on the short list provided by a committee formed by the liberal government outgoing, following the retirement of John Major at the beginning of 2006. The Prime Minister Stephen Harper chooses Rothstein like candidate of its government at the Supreme court.
Many Canadian conservatives had a long time criticized the process of nomination of the judges at the Supreme court, which was traditionally a unilateral decision of the Prime Minister, without any help coming from other politicians, especially of the opposition. The chief of the Conservative party, Stephen To grip, had thus made the promise to reform the process of nomination during his electoral campaigns.
As soon as after the selection of Rothstein, the Harper Prime Minister creates a special Comité charged to study the nomination of one candidate at the Supreme court of Canada , a new creation of which the goal was to allow the nominated one to face the questions of the federal Député S, inspired of the lawsuit as a vigor in the United States. The committee was chaired by the constitutional law professor Peter Hogg.
The committee was discussed. Several preserving critics protested that it did not go enough far, while the liberal critics affirmed on the contrary that it went too far. To grip was clear that although the special committee would have the capacity to question the candidate, it would not have the capacity of veto on the nomination - contrary to the committees similar to the United States which has this right. Moreover, the deputies being part of the committee were informed to abstain from putting questions about the personal opinions of Rothstein on morals questions or the subjects of future court orders possible.
Although it had been on the short list of the liberals, Rothstein was regarded as most preserving of the three candidates. During the session, Rothstein was questioned on its legal philosophy, and he declared that he did not support the legal Activisme, and that the courts were to show extreme prudence when they made decisions which would reverse laws voted by the Parliament.
After the publication before the committee, Rothstein was officially confirmed like the candidate of the parliamentary executive on March 1st 2006; the candidature was confirmed by the general gouverneure Michaëlle Jean, and Rothstein was named at the Supreme court the same day.
