Marriage certificate
A marriage certificate is a legal Document of the civil statue. It is a authentic Acte, emitted by a Officier of civil statue, which makes the legal proof of the marital situation of the husbands.
It comprises the obligatory mentions of an act of civil statue (year, day and hour of emission, first names and name of the officer of the civil statue, first names, names, professions and residences of all the named people), but also:
- dates and birthplaces of the husbands,
- first names, names, professions and residences of the fathers and mothers,
- the declaration of the contractors to be caught for husband, and the delivery of their union by the officer of the civil statue
- first names, names, professions, residences of the witnesses and their quality of major;.
If it is necessary, must also appear in it
- the Consentement of the fathers and mothers, grandfathers or grandmothers, and that of the Board of guardians;
- first names and name of the joint precedent of each husband;
- the date of the marriage contract, and the name and place of residence of the notary who will have received it;
- the statement which it was made an act of designation of the applicable law in accordance with the Convention on the law applicable to the matrimonial modes, the date and the place of signature of this act and, if necessary, the name and the quality of the person who established it.
The lapse of memory of one of these mentions engages the civil responsibility of the officer of civil statue, and exposes it to a civil fine.
