Mâlik Ibn Anas

Mâlik ibn Anas or sometimes Imam Mâlik (complete name Abou Abdallah Mâlik ibn Anas ibn Mâlik ibn “Amr ibn Harith , in Arab: rear RTL أبوعبداللهمالكبنأنسبنمالكبنأبيعامربنعمروبنحارث) (approximately 715 - approximately 795) is Moslem lawyer, founder of one of the 4 legal schools (Madhhab) of the Moslem Droit Sunnite (school known as Malékite). Born with Médine, he will know the transition between the period from the Caliph S Omeyyades and that from the Abbassides. This period of expansion of the Moslem empire sees appearing the strong need for Juridiction, in particular in the new conquered territories.

It leaves a work, the way levelled , in which it gives a table of the law, right and religion médinoise. It leaves also a book of collection of Hadith and legal opinion companions of legal Mahomet major: Al Muwatta .

He admits, and his school with his continuation, in addition to the Coran and the Sunna, the “habit” (urf or Bil Mahrouf) médinoise, the consensus (idlma) of the doctors médinois and the principle of the general utility.

Its school considers that the examples of legislation in progress with Médine of the time of Mahomet are sources of Moslem Droit.
