License BSD

The license BSD ( Berkeley Software Distribution license ) is a free License used for the distribution of Logiciel S. It makes it possible to re-use whole or part of the software without restriction, whether it is integrated in a Free software or owner.

The original version of license BSD included a clause of particularly constraining Publicité which obliged the mention of the Copyright in any publicity or document provided with the Logiciel, which could cause some problems in the event of use of a great component count under this license. The new version of this license does not contain this clause of publicity.

Text of the license

The text of the license (in English) is in the Public domain and can be modified without restrictions. To correspond to particular needs for an organization or a person, original terms of " Regents off the University off California" , " University off California, Berkeley" , and " Regents" can be replaced. It is here about the version without the clause concerning the publicity and which was withdrawn in 1999.

Difference compared to the public domain

License BSD is one of the least restrictive in the computing world and approaches the concept of “public domain”. Should however be noted important differences:
  • the concept of public domain varies according to the legislations. In general, the author must be dead since a certain number of years so that its work falls officially into the public domain. License BSD defines a clear framework of use.

  • license BSD imposes certain constraints during the redistribution, which is generally not the case of a work in the public domain;
  • it makes it possible to protect the authors as for employment from their name in derivative products;
  • it discharges the authors from the possible known or unknown problems related to the use of the code

Use in software owners

License BSD allows the commercial use in products owners. The software published according to the terms of this license can be built-in solutions commercial owners ou/et. The work based on elements under license BSD can even be published under a license owner (which must however respect the clauses mentioned in license BSD). Among the notorious examples, one can quote the use by Sun of code network under BSD, and the components coming from FreeBSD in Mac OS X.

Compatibility with other free licenses

The code under license BSD can be published under license LPG without the assent of the original authors since the terms of LPG respect all those of license BSD. Nevertheless the redistribution must take account of the first clause of license BSD. Moreover Theo de Raadt (leader of OpenBSD) thinks that one can decide license of a software only if one is the author (or one of the authors) of the code in question. If an author wrote a code in license BSD, that a second author B brings significant changes, then it can choose to put its code under LPG. But the code of has would be always under license BSD.

On the other hand: code under license LPG cannot be put under license BSD without the authorization of the authors because license BSD does not respect all the constraints imposed by the license LPG. By publishing code LPG under license BSD, one would authorize for example the redistribution without providing the source code whereas it is prohibited by the terms of the license LPG.

License BSD contained before 1999 an “advertizing” clause which posed several practical problems: All advertizing materials mentioning features gold uses off this software must display the following acknowledgment: This product includes software developed by the University off California, Berkeley and its contributors.

The affixing of " University off California, Berkeley" was not obligatory but was to be replaced by the authors. In 1997, the code of NetBSD comprised 75 alternatives of this sentence (for each speaker), which implied to write 75 times of continuation a similar clause within the framework of a publicity.

At the time of the revision of license BSD, the director of the Office off Technology Licensing of the University of California the July 22nd 1999 confirmed that this clause (n°3) “was withdrawn in its entirety”.
