Legislative inflation

The legislative inflation is the growth of the number and length of the Loi S.

In France, the average length of the Official journal thus passed from 15.000 pages per annum in the years 1980 to 23.000 annual pages these last years, while the Recueil of the laws of the National Assembly passed from 433 pages in 1973 to 2.400 pages in 2003 and 3.721 pages in 2004.

This evolution does not hold so much with an increase in the number of voted laws, which remained about stable during the ten last years (45 laws voted during the year member of Parliament 2005-2006 compared with 46 in 1997-1998, except laws authorizing approval or the ratification of conventions and treaties) that with a lengthening of the laws, which often exceed from now on the 100 pages.

In 1991, in its public Report/ratio , the Council of State deplores “logorrhée legislative and lawful one” and ceaseless instability “and sometimes without cause” of the standards. Recently, the criticism of legislative inflation found an echo media particular, continuation in particular with the critics of the vice-president of the Council of State Renaud Denoix of Saint-Marc, of the president of the Constitutional council Pierre Mazeaud or of the president of the National Assembly Jean-Louis Debré. The proliferation of the laws again was the object, in 2006, of the critics of the Council of State, which sees a factor of “legal insecurity there”.

New fields

The right must also adapt constantly to the emergence of new fields and the appearance of new constraints.

Out of economic material, many aspects of the Droit of the businesses are the subject thus of adaptations to an environment mondialized. The Liberalization of new sectors (transport, telecommunications, energy,…) the introduction of new rules requires.

In the scientific discipline, the development of the Biotechnologies makes necessary the regular revision of the laws on the Bioéthique. The rise of information the Technologies and the communication in particular caused the installation of a legal framework adapted to the development of the digital economy and an new approach of the intellectual property. The need for the safeguard of the Environment and the Sustainable development involves also the frequent intervention of the legislator.

“Pathogenic” factors

“To strike the opinion or to answer the requests of the various social groups, the political action took the form of a legislative gesticulation” deplored Renaud Denoix of Saint-Marc in 2001 It is thus for example which with the re-entry 2007, following several accidents, sometimes mortals, implying dogs, five private bills on the dangerous dogs were deposited with the National Assembly and one with the Sénat, before the Gouvernement does not file in its turn a bill.
