The instruction by the prosecutors of Cologne lasted three years and half. The lawsuit began the October 23rd 1979 with the court from the Land in Cologne and taken end the February 11th 1980. This lawsuit made it possible to highlight personal knowledge that the defendants had goal and destination of the deportation of the French Jews.
On the basis of Treaty “of Paris” or “Treaty of transition” concluded in 1955, the criminals Nazi S were protected from the judgments of the combined military tribunal, since it excluded a judgment in Germany on the basis from the called upon facts and that as German citizens, they could not be extradited.
It is only in 1975 that the German Bundestag ratified an agreement complementary to the “Treaty of transition” which made it possible to put the criminals like Lischka as well as others in charge. The defendants Kurt Lischka, Herbert Hagen and Ernst Heinrichsohn were shown Déportation and assassination of: 40000 French Jews.
