Law of June 30th, 1838

The law of June 30th, 1838 is a law promulgated under the reign of the king Louis-Philippe, said " Law of the alienated " , which treated Institution S and assumption of responsibility of the mentally ills. This law remained almost completely validates until 1990. (see paragraph Evolution).

Initiative of the law

Before 1838, no matter who could make hospitalize someone else, which constituted a serious problem, because of abuse: Certain people, on pretext of madness, were thus sent to asylum, and their goods were recovered by the family or the close relations. Other share, the conditions of internment were badly defined and of many internees still lived under miserable conditions.

Major contributions

This law allowed three great contributions French psychiatry and the treatment of the patients:
  • Institution of a psychiatric institution by department .
  • Better conditions of internment of the patients: the law allowed for example the installation of activities remunerated for the patients inside the establishments.
  • Concept of placement voluntary and placement of office

Contents

  • Organization by departments of the care to the " aliénés".
  • All the establishments, which they are private or public, from now on are placed under control of the Public authority.
  • Creation of various methods of Internment:
* voluntary Placement.
* Placement of office: of two types
* at the request of a third
*demandé by the prefecture
These placements require a medical opinion delivered by a doctor, and an opinion of the prefect. If the patient must be kept in hospitalization, its file must be re-examined by the prefect.
  • Creation of a Legal status for the mentally ills.

Evolution

  • the law was the subject of critical sharp with regard to the methods of internment, which derogated from the constitutional principle of individual freedom, the hospitalization known as free not having been envisaged by the Législateur.
  • the legal status of the mentally ill was completely modified by the Loi of January 3rd, 1968, which reformed the right of the " incompetents majeurs".
  • the law nevertheless was effective until the vote of the Loi of June 27th, 1990, " relating to the Right S and the Protection of the people hospitalized because of mental disorders and to their conditions of Hospitalization ".
