Law Mahoux on the prohibition of the submunitions
A private bill prohibiting the weapons at submunitions (of Philippe Mahoux of the Belgian Socialist party) was adopted by the Belgium on February 16th, 2006, it is the first country has to adopt such a law.
This prohibition through law in Belgium since May 18th, 2006.
June 16th, 2005, the Sénat had already adopted the " proposal; Mahoux" of prohibition of manufacture, the use or the detention of anti-personnel mines, this project was examined in December 2006 by the committee of supply of the Room (Doc. Senate 3-834/1 to 6; Room 51-1879/1).
Provisions of the law
Any institution financing directly or indirectly a Undertaken whose activity, was this only additional, consists to manufacture, use or hold anti-personnel mines, becomes penally responsible in Belgium.
These activities are now punishable and comparable with money laundering and financing of terrorism.
The text also says that an financial institution granting a credit line a company will have to subject a declaration to him by which this one confirms that the financing will not cover the manufacture of anti-personnel mines.
If a conglomerate requests a financing for its activities in Belgium, whereas one of its subsidiary companies abroad is actively implied in manufacture, the use or the detention of anti-personnel mines, it will have to confirm by declaration which it will not intend the appropriations granted in Belgium for the subsidiary company in question.
