Law Jospin
The law of orientation on education of July 10th 1989, known as also law Jospin (of the name of the Minister for State education Lionel Jospin), is a law which largely modifies the operation of the education system.
It is composed of an article first which are not attached for no reason and of six titles:
- school life and university
- the personnel
- educational establishments
- advisory organizations
- the evaluation of the education system
- various Provisions
It is accompanied in appendix by a report/ratio by orientation (like are in theory all the laws of orientation).
Great principles and objectives
Most of the law is intended more to point out or found general principles and objectives that to found precise modifications of operation.
In particular, its article 1st has value of program for the entire education system and starts with this sentence:
Education is the first national priority|Law Jospin, Article 1st, today Code of education, Article L. 111-1.
The law stresses that the pupil or the student must be an actor of his clean orientation and not to undergo it.
The law points out the existence of a “educative community” already affirmed by the Loi Haby. She insists on the need for integration of the pupils and student handicapped.
Among the objectives of the law appears that to lead the whole of an age group to the level of the Vocational training certificate (CAPE) or to the Brevet of professional studies (BEP) and 80% of the same age group to the Baccalauréat.
Reforms
The law organizes the schooling in Cycles, three for the primary , two for the college, and of the more or less many cycles to the college according to the dies. It creates a National council of the programs to deliver opinions on the School programs.
For the training of the teachers, the law envisages the creation of the Academic institutes of training of the Masters (IUFM). These administrative public corporations with character must ensure a formation and a professional culture common to all the teachers of the primary education and secondary. The creation of the professors of the schools is the direct consequence of the creation of the IUFM.
The national Superior council of education and the Council of mainstream education and technique amalgamate in a single authority which takes the name of Superior council of education. This authority loses however its contentious and disciplinary role with regard to the higher education, which is entrusted to CNESER. The competence of the academic councils sees their competence being extended to higher education and a single council is created for the Île-de-France.
The schools, colleges and colleges are held to work out and to apply a Projet of establishment which details the placement of the national targets and adapts them if necessary.
The law specifies the statute of the Greta while making some of the groupings of public interest.
Evolution
The law Jospin was codified in 2000 but what she affirms and founds is still largely in force.
The principal modifications made by the law Fillon of 2005 are:
- the fastening of the IUFM to the universities;
- removal of the National council of the programs.
