Latent defect

A latent defect is a defect or an imperfection in an article discovered after the purchase and that the Acheteur could not have discovered by a surface examination. These defects is not discovered by a examination or tests of routine, since they are present as of the outline of the production and appear only with the use of the object in question.

Generally, it is duty of the Vendeur to refund the good or to find a replacement to him, without defect for this one, because that enters the guarantee " implicite" of quality which any salesman owes with his purchaser.
