Jurisconsult

Derived from the Latin juris consultus , consulting in right , the term extends to the teachers and the authors from the legal field but more especially to the theorists, with the thinkers of the Droit. It is with the Rome IIe century before our era that returns to have, the first, set up the right in Doctrine.

Jurisconsults under the Roman Republic

At the time Roman, the jurisconsults were patricians, that is to say the noble resulting ones from the more big families. They were not paid for the councils which they gave as regards right because they regarded that as dishonouring.

The opinions of right of the jurisconsults formed what one called, with the Roman direction of the term, jurisprudence ( iuris prudentii ) i.e. literally: right of careful, those considered then as of the advised people who thought of solutions of right.

Under Hadrian, the lawyer Salvius Iulianus, known as Julien, under the name of perpetual Édit a compilation of the edicts of the Préteur S publishes, amorçant a centralization and a resequencing of the legal corpus.

the Emperors of the 2nd century and especially at the beginning of the 3rd century delegate an increasingly important legal role to the prefects of the court. The social evolution and the soliciation on the scale of the Empire oblige with the evolution of the right, whose the services of the prefecture of the court discharge.

Among the large lawyers of this time, one can in particular quote Ulpien (death into 228), Paul and Gaius. Their writings will make legal matter authority a long time. (See the Law of the quotations).
