Jean-Baptiste Selves
Jean-Baptiste Selves , born with Montauban in 1757, died in Paris the July 16th 1823. Jurisconsult and magistrate. He followed in his youth the occupation of lawyer at the Parliament of Toulouse and fills at the same time the judging functions with the présidial and the provostal court of Montauban. President of the court criminal of the Batch, appointed the Council of the Five hundred in 1797, named by Bonaparte judge with the criminal court of the Seine then president of the criminal court of Montauban in 1801, appointed Batch at the 19th century.
- Its opinions, so that it appears, were not initially favorable to the innovations revolutionist, and it was in hillock with the first excesses which announced this time. He teaches us itself, that the pomegranates of the regiment of Touraine, excited against him, seized its residence, broke his pieces of furniture, and that it did not prevent being hung by them, that while running away themselves on the roofs of its house, and while going to hide in Toulouse. However it is seen that it was put up later with the changes which took place; because it accepted several of the functions which were created.
- Appointed president of the criminal court of his department (the Batch), in a time or the parties, which triumphed and succumbed turn-with-turn, was sent also turn-with-turn to the scaffold, it could reconcile its duty with humanity, and rendered important services to several proscribed, in particular with the count de Beaumont, nephew of the archbishop of Paris, with Madam de Fumel etc It tells that it prevented the sale of a good of emigrant producing thirty thousand Francs of incomes, and that the emigrant, with his re-entry in France, recovered this beautiful property.
- Jean-Baptiste Selves named, in 1797, by its department, deputy with the the Council of the Five hundred; but this election was cancelled by arbitrary measurements which followed the revolution of the 18 fructidor (September 4th 1797).
- Bonaparte, arrived at the capacity, appointed it judge with the criminal court of the Seine; it sat in this court at the time of the lawsuit, made in 1804 with Jean-Charles Pichegru, George, Jean Victor Marie Moreau and with a great number of agents of the Bourbons, on the occasion which was made to reverse Bonaparte and replace the authority in the house of the Bourbons. Jean-Baptiste Selves was one of the five members who opinèrent against Moreau with the capital punishment. Lecourbe, his/her colleague, having, with the return of the king, in 1814, makes known, in a booklet, the circumstances of the debates which had taken place between the twelve judges, Selves answered him, and if it were not furnished proof to the impartial spirits, on the severity of his opinion, it at least left only one light doubt about the little of base of the reproach which was made to him, have been one of the judges who, having left the room of the council, during the deliberation, went, in the close part, to act in concert with Réal and Savary, and did not redden of to yield to the suggestions these two negotiators, by selling their opinion in Bonaparte. Selves claims that it was not sold, and that it believed only to be right while being rigorous (Selves developed, on its doctrines as regards conspiracy, of the principles which we could not adopt. Those which seek to break a usurping mode and to restore the legitimate order, will undoubtedly find, when they fail, of the men all prèts to condemn them, but the stop will be the dishonor of the individuals who will have taken share there. Legitimacy is a true paternity of which the rights cannot be made problematic by events whatever they are, and one is never guilty in the efforts which one makes to point out it, because it is with-the-time duty and justice. The author of this article speaks this language according to his conscience; he does not have need to speak thus, to remember that he was beside the victims of this unhappy attempt, and that the escape alone prevented it from sharing their fate.). At all events, that Selves yielded to the capacity, like claimed it Claude Jacques Lecourbe, or that it served it by conviction, it kept its… (lack the continuation page 546).
- In 1811, not having been included/understood in the organization of the Court of Appeal of Paris, it started as of-at the time this long work of baffle which made it famous to the palate. In a crowd of writings it tackled the solicitors and the judges with transport and passion, but often with justice. From there of frequent lawsuits, many persecutions, of which it did itself the prolix account, and who lasted until his death, in 1823.
- It was litigious engaged in more than one hundred lawsuit what caused him its ruin.
-
Jean-Baptiste Selves had a son: Henri Antoine Auguste Selves, born in Montauban the July 2nd 1790, printer lithographer, general adviser and deputy of Seine-et-Marne of 1837 with 1839.
