International court of the right of the sea
The International court of the right of the sea is a legal body independent created by the Convention of the United Nations on the Right of the Sea in 1982.
Mission
The International court of the right of the sea informed and judges the disagreements to which place the interpretation and the application of Convention could give.It confirms that the duty applicable to the Navire S is that of the Flag state.
Operation
It is installed with Hamburg (the Federal Republic of Germany) and is composed of 21 judges, selected for their maritime matter competence and assisted of 38 employees.
Principal stops
TIDM 1999 Business Saïta: in the stop, TIDM affirms that the Octroi of house was opposable full with the states. When the State grants a house, it must exert a substantial right on the ships. Article 91 specifies that “it must exist a substantial bond between the State and Navire" , some had interpreted it like the possibility of fighting against the houses of complaisence, prohibiting any registration in a State not having a bond of fastening, this interpretation was rejetté.
