Incidental request
The expression incidental request indicates any request which does not open the authority (contrary to a Assignation or a RequĂȘte) but which intervenes during an already committed lawsuit.
- if it emanates from the applicant, one speaks about additional request: the request is new but it must be related with the initial request.
- if it emanates from the defendant, one speaks about counterclaim: the defendant present of the means of defense and attacks in his turn by formulating requests against that which introduced the authority.
- if it emanates from a third, one speaks about voluntary intervention: the third agrees to intervene in a procedure in progress.
- if it is directed against a third, one speaks about forced intervention: the applicant or the defendant, decides to blame a third within the framework of a procedure in progress.
