The shifted treatment of this subject caused in France polemical sharp (in particular of the complaints of association S old off-set S), and led to the prohibition of this cartoon, as in many European countries, posing with the jurisdictions these countries the question of the limits to the Freedom of expression.

The legal situation in various European countries

In France

The work will be the subject of several legal procedures: three judgments, including two that the authors will lose (the first and the third), and where they will carry it. Vuillemin will be defended by Thierry Levy, lawyer penalist who later will also defend Jean-Louis Costes during his lawsuit for Racisme and which will become president of the International observatory of the prisons of 2000 to 2005. The February 27th 1989, Gourio and Vuillemin are condemned for this cartoon by a civil judgment to pour frank a symbolic system. The cartoon is prohibited in her version newspaper. The integral version (in album) is prohibited of sale to the minors, and prohibited in exposure.

In June 1989, at the time of a debate between Vuillemin, Gourio and the draftsman Gotlib, published in number 85 of the Books of the data base and treating this cartoon, Gotlib brings its moral support and professional with the two authors in the name of freedom of the press. He however states to understand that the reader can be shocked by this cartoon (the family of Gotlib having been victim of a raid by the gendarmerie in 1942, from which only him and his/her sister escaped), and issues reserves on the too extreme form according to him of the work.

In Spain

In Spain, several lawsuits and appeals to justice were spread out beginning of the Années 1990 until December 1995, and opposed Damián Carullá (directing of the Spanish publisher Makoki which published the cartoon) to associations B' nai B' rith of España and Amical of Mathausen. Associations regarded this cartoon an attack with the dignity of old the off-set S but also as an attack towards a religious belief (reached then regarded as an offense in Spain), the Judaïsme, while Damián Carullá considered that it was about a parodic work of which the only goal was to ridicule the positions revisionists on the Holocauste.

The second room of the Spanish Constitutional court gave finally wrong to Damián Carullá, the December 11th 1995, by refusing its request for recourse. The Court based its decision on jurisprudence (the case Violeta Friedman- Leon Degrelle, in November 1991), while considering that the cartoon had for " total goal '' to humiliate those who were prisoners of the death camps, not only but mainly the Juifs ". It also based its decision on the assumption that the public of this type of edition (cartoons) is a young assistantship , not very mature, and thus influenceable. The Court also regarded the work as incentive with the Haine and the Violence.

Contents

The title of the album is a joke, resting on the fact that Hitler was in an obvious way has minimum S, the expression " S " being able to be also an insult or a slogan intended to vilify somebody by comparing it to the Nazis. This type of humor is found throughout the album, the Nazis being made treat with repetition of fascists.

On the French edition in album, a mini romantic picture story opens the cartoon. It puts in scene Vuillemin and Gourio vis-a-vis officers Nazis (of which one is played by the Professor Choron) to which the cartoon does not like, considering that “ This beautiful army German, you trailed it in mud ”.

The first cartoon, the train of happiness , puts as for it in scene a group of people whom the Nazis prepare with to off-set in a Train, but who do not realize of nothing (“ It will never arrive this whore of train ” “ If you want my opinion, that begins all this history badly”). Only a homosexual becomes aware of the situation, but the other deportees prefer not to listen to it, to make fun of its homosexuality, to end up beating it with death. Vuillemin will declare into 1996 that the idea of this cartoon had come to him and Gourio, when at the time of a commemoration organized by former deportees in the neighborhoods of 1983 with Lyon, former homosexual deportees had seen themselves some excluded.
