Higher court of call

With Saint-Pierre-and-Miquelon and Mayotte, the higher court of call has competences similar to those which have the course of call in the remainder of France. It is made up:

  • of Magistrate S of the legal order
  • and possibly of assessors to the higher court of call, which are appointed by the Minister of Justice for two years, on a proposal from the president of the higher court of call, after opinion of the public prosecutor, among the people of French nationality, old of more than twenty-three years, presenting guarantees of competence and impartiality and “enjoying the political, civil rights and of family” (in Mayotte) or “having made the object of no judgment, incapacity or forfeiture envisaged by the articles L. 5 and L. 6 of electoral code” (with Saint-Pierre-and-Miquelon).

Magistrates

According to the ordinance n°58-1270 of the bearing December 22nd, 1958 organic law concerning to the statute of the magistrature, Article 28-2, the president's functions and of public prosecutor of a higher court of call are exerted respectively by an adviser or a substitute of the public prosecutor of the Court of Appeal of Paris.
