Guy Cockles (November 11th 1523, Decize in Nivernais - March 11th 1603), in Latin Conchylius , sior of Romenay; jurisconsult, publicity agent and poet French. Lawyer in Paris, then in Nevers (1569), public prosecutor of the duchy of Nevers (1571), it opposed the League. Representative of the third to the states of Blois (1576 and 1588), he was the principal writer of the Books of this kind.

Its most important works are the Institution with the right of French , the Coutumes of the country and duchy of Resident of Nevers (v. 1590), in which it proves to be a true pedagog of the common law, and the Traité freedoms of the Church of France (1594), in which it establishes the legal theory of freedoms of the Church gallicane.

Biography

Born in Decize in the Resident of Nevers, on November 11th, 1523, wire of a grenetier of Decize; one finds in this " city; the house of Guy Coquille" , street of Doctor Gras; it “is informed in grammar”, with the Collège of Navarre, Paris; then “went itself from there to study the right in the schools of Italy, which one still then looked at like the purest sources of jurisprudence. Shell had as a Master Marian Socin the young person, professor famous of the university of Padoue; but though he had studied under doctors ultramontanes, he recognized all the defects of them, as one sees it by the judgment that he relates from there in the foreword of his Comment to the habit of Nivernois.

it does not advise in François to stop with these doctors, but with others which have the clearer light of understanding & better hearts as well in fact of conscience as of honor ”.

Shell improved in France, and acquired more solid instructions in Paris in a Prosecutor, then during three years as secretary of its uncle Guillaume Bourgoing adviser at the Parliament of Paris; then it went during two years to the university of Orleans.

He exerted then as lawyer while taking part in the Great days of Mills, in 1550, then in Paris lasting 3 years.

He returns in Decize, perhaps in the family laison, and he Marie; after the fire of Decize, it will reside at the castle of Romenay (Aubigny Dienes), which will be worth to him to be called sior of Romenay . In 1559 fixes itself at Nevers where its reputation extends quickly. It is appointed State Third, of Nevers , with the General states of Orleans in 1560.

In May 1562, it was sent to Clèves, in Germany, by François de Clèves II.

The untimely death of his wife could only make him give up its fashionable life, and commit it to come to Nevers, where he was elected like first Alderman in September 1568; it will be it during two years.

… And as it marks that it was during the civil wars, it should be believed that one it avoit selected like a man, wisdom & control for of which one avoit need in a so annoying time. Indeed, it put there of so good orders that the town of Nevers since this time of best was regulated the ”.

It became there soon the oracle of its province; its reputation extended even beyond this narrow enclosure. One came to consult it everywhere. He followed the lawyer occupation with a so rare satisfying, which he often returned part of the fees that one voluntarily gave him, and that he distributed to poor the tenth of what he kept.

He had been appointed with the states of Orleans in 1560, and he will be it with those of Blois in 1576 and 1588; in these circumstances, he was the principal writer of the Cahiers of this kind, and added to his fame of jurisconsult that of a honest and courageous citizen, while not ceasing claiming representative assemblies public freedoms, the reform of the clergy, the religious liberty and the eradication of all the abuses.

Since it had fulfilled this honourable mission as a good citizen, and that it came to be contained in his modest retirement, Louis de Gonzague, duke of Nevers, which had for him regard and attachment, had much sorrow to make him accept the place of sound " Tax prosecutor of Nivernois & Donziois" , which was sought per so many others, in 1571.

One can notice that in 1572, the year of the St. Bartholomew's Day Massacre, Nevers did not know violences and much thought that it is in Guy Coquille that one owed this calm.

It is probably by recognition for this benefactor, that it started to write its Histoire of Nivernois , like his Commentaire on the habits ; it is as to maintain to the row of Mister the Duke of Nevers as it E crivit the Report of the pars of France.

With the request of this same Prince, Henri IV, who liked besides to attract at his court the advisable men by their talents and their probity, unnecessarily offered to him to make it advise State.

In November 1576, it was sent to the first States of Blois, where it will remain until March 1577. One preserved his books, as well as testimonys of his fight for the abolition of Bourdelages in Nivernois.

Lastly, in September 1588, it will be sent third once to the second States of Blois and there will write new books.

Though all its time was almost absorbed by the exercise of its profession and its various missions, it did not only leave conceal a few moments there to cultivate the Greek, Latin and French Muses: the queen Marguerite , first woman of Henri IV, with which it was in relation, had to him of the invaluable information, of which it made use in her Mémoires . It provides to Pierre de Brantôme , his close friend, the principal materials of its work of the famous Dames of its time . It was friendly of Jean Bodin, of the chancellor Michel of Hospital and famous the Francis Bacon.

Shell died octogenarian, on March 11th, 1603.

Its work

The poet

He had composed, in his youth, of Latin poetries which are not in the edition of its works; it was the only one of its works that it published itself: Guidonis Conchylii Romenoei Nivernensis Poemata, Nevers, 1599, in-8th. It is also said that it was meant there well in Greek and that it had translated the Odyssey of Homère.

In its worms, it fades the corruption of its time, the venality of the public men, the greed of the courtiers, religious fanaticism, and it exhales painful complaints there on miseries of its fatherland.

Political writings

In its function of tax prosecutor, it was pointed out like one of the large theorists and the Absolute monarchy and the Church gallicane as proves it, in 1594, the publication of sound Traité freedoms gallicanes . For him, “the roy is the chief and the three orders are the members; and all together make the body politic and mystical, whose connection and union are individue and inseparable, and cannot left to suffer badly that the remainder does not feel and suffers pain from it”.

The commentator of the common law

Shell is, moreover, one of the large persons in charge of the update of the habits. It makes appear, in 1590, a Commentaire on the habit of the country and duchy of Resident of Nevers , then, in 1595, the Institution of the right of the French which makes of him the best commentator of the common law of the north of France. Very attached to its province, he becomes about it the historian appointed by his History of the Resident of Nevers (1595).

Except for these treaties and poems previously quoted, the other writings of Conchylius, sior of Romenay were published only after its death, by the care of Guillaume Jolly, who added a life of the author to it. All its works were collected, Paris, 1666,3 vol. in-fol. One finds there a Histoire of Nivernois , completed in 1595, which passes for exact and faithful, and that Loisel had published in Paris, 1612, in-4°; one sees there also the Traité freedoms of Church gallicane , which had been catch to him of alive sound, and which one found only about the middle of the 17th century. There are another edition of works of Shell, Bordeaux, 1705,2 vol. in-fol., fuller than the first. All its works, its political opuscules, its lampoons against the members of a league, its works of right, its Latin poetries, are impressed nobler feelings and the purest patriotism.

Anecdotes

Like the large lawyers Charles Dumoulin and Jean Bodin, it distinguishes monarchy seigneurale with royal monarchy. For him " the king is monarch and does not have a companion in his Majesty royale"

The town of Decize raised a statue in to him 1849.
