The vote of censure of October 5th, 1962

The National Assembly having voted a motion of censure on October 5th, 1962, the Prime Minister, under the terms of article 50 of the Constitution, gave at once the resignation of the government to the president of the Republic. However, this one refused it and chooses to dissolve the National Assembly on October 10th.

Certain constitutionnalists still question themselves to know if, in the absence of being illegal (the Constitution being dumb on this precise point), this refusal to accept the resignation was not sullied with a certain illegitimacy.

Quarrel of experts, since the electorate sliced by electing a new Parliament in conformity with the wishes of the executive power.

It should be noticed that, in the facts, the government behaved, for the election time, like a cabinet dispatching the go concern , as testifies some the temporary addition to the wallet of State education to competences of Louis Joxe.
