Gerard Schivardi

Gerard Schivardi , born the April 17th 1950 with Narbonne, is a Politician French, “Socialiste, Républicain and Laïc”. It is Maire of Mailhac and founder of the National committee for the reconquest of the Démocratie . Being presented in the form of a “candidate of the mayors”, it was invested by this committee for the French presidential election of 2007. Its candidature, supported by the Party of workers (Pt), joined together 0,34% of the votes cast.

It received the medal of money of courage and devotion for its personal action of rescue of the inhabitants of its commune during the Inondation of its village in October 2001.

Gerard Schivardi is Master craftsman Maçon since 1970. He is married, father of two children.

Political course

Local engagement

It engages in the trade unionism and is president of the trade union of the masons of the Aude of 1973 to 1988. In 1975 he becomes member of the PS, and nearly thirty years until in 2003 will remain it. He will be also federal secretary of the Socialist party for all this period.

He enters to the municipal council of Mailhac in 1989 then becomes mayor of this commune in 2001, each time under the label of the Socialist party.

In 2002, it brings its sponsorship to Daniel Gluckstein, national secretary of the Parti the workers, then candidate with the presidential election on the basis of defense of communal freedoms, one of the key points of the profession of faith of this candidate.

In 2003 he is candidate with the cantonal elections in the Canton of Ginestas, against the candidate invested by the Socialist party. He centers his countryside on the defense of the public services. Elected at the conclusion of the first turn, it must leave the PS and since adhered to no other party, while continuing some to say itself “socialist”, “republican” and “European convinced”.

Shortly after its rupture with the Socialist party, Gerard Schivardi approaches during a few months the regionalistic coalition “Languedoc and Catalogne”, from which it considers during one moment to be the chief candidate to the regional elections of 2004, while taking reserves: “So in your program, said it, you indicate that initially the defense of the democracy, it is the commune, the general adviser of the canton of Ginestas, that I am, will raise the question then (…) If that must remain an instrument to develop the culture, I give you a knack. On the other hand, if is to make a State in the State, that is more difficult for me” . It retracts however quickly, saying “refractory to the disengagement of the State to the profit of the areas which induces an inequality for the citizen” and takes his distances with the coalition separatist all while approaching the Party of the workers within the framework of the defense of the communes against the “Intercommunalité forced”.
This bringing together of a few months between Schivardi and the coalition “Languedoc and Catalogne” gives place to a controversy in February 2007 when Nicolas Miguet, in an official false document envoys with the elected officials of which he hopes to obtain sponsorships, claims that Gerard Schivardi supported the list separatist with the French regional elections of 2004. National engagement

It starts in 2002 to engage at the national level by the foundation of a committee which extends quickly in France to defend the existence, institutional and economic, of each one of: 36000 common republican Frenchwomen and of the national public services of proximity while being opposed so that it calls “the forced intercommunality”.

Being opposed to the institutions European Union, he decides at the time of a national demonstration on September 20th 2003 against the project of new constitutional treaty for the European Union. At the conclusion of this demonstration east the “National committee for the Republic One creates and Indivisible”. It takes part in creation in October 2004 of the “National committee for the victory of the vote not to the referendum, for Europe of the people and free nations”.

Following a national demonstration in Paris in September 2004, it animates and constitutes the “National conference of defense of the communes and the public services” with other politicians like Aimé Savy (9th assistant MRC of Ivry-sur-Seine) and Daniel Gluckstein.

Candidature for the presidential election of 2007

On Saturday, November 18, 2006 takes place a demonstration with Paris which gathers, according to its organizers, close to: 10000 workers, citizens, like several tens of elected officials and hundreds of trade unionists. It is followed of a meeting where speak in particular Gerard Schivardi, Daniel Gluckstein, Aimé Savy, Guido Montanari (teaching at the University of Turin and trade unionist), then of a meeting associating forty mayors elected by 300 of their colleagues of the “Collective of the Mayors”, and, of the “National committee for the Reconquest of the Democracy” (CNRD) . They decide on a collective candidature of the mayors, and adapting to the form of the “personalizing” poll, designate Gerard Schivardi like “candidate of the mayors” to the presidential election.
Its countryside is articulated primarily around six points of its profession of faith:
  • for the defense of the public services;
  • for the reconquest of the Democracy political and social;
  • for the defense of: 36000 common, against the regroupings forced via the Intercommunalité;
  • against the industrial and rural turning into a desert;
  • for the laic Republic ;
  • for the rupture with the Treated of Maastricht, the European Union and its directives.

Gerard Schivardi engaged, inter alia, to restore the prerogatives of: 36000 communes, to proceed to the Nationalization and renationalization of the key sectors of industry and the banks without compensations (except for the “small shareholders”), ceasing subjecting the nation's economy to the Pension funds like with the re-establishment of the public services and the monopoly of the State, with the abrogation of the laws “anti-laymen” installation by the various right governments and of left and with the restitution of the 175 billion euros of exemptions of wage contributions at the profit them owners, in order to reinflate the social security, and particularly to reopen the hospitals and maternities of proximity. This set of measures could come according to him only from one sovereign constituent National Assembly which would break with the Traité of Maastricht and the institutions from the European Union. He declared that if he would have been elected, he would have been president only for two months, time to join together this assembly.

On several occasions, Gerard Schivardi protested against what he considered being a “true Boycott ” of his candidature by the media, by in particular comparing its speaking time on television measured by the SCUMS (11 minutes 3 seconds) with those of other “small candidates”: Corinne Lepage (1. 29 mn) or Nicolas Dupont-Aignan (1. 21 mn).

March 6th, 2007, Gerard Schivardi takes part in the manifestation of paid of Airbus for the maintenance of all employment, all the sites and the withdrawal of the Plan power 8. He decides for the nationalization of Airbus and the abrogation of article 87 of the treaty of Maastricht prohibiting the State aid “likely to distort competition”.

March 10th, 2007, Gerard Schivardi announces in a national press conference to have joined together and have deposited 539 Parrainage S (554 sponsorships finally deposited and validated by the Constitutional council). He recalls in this official statement the pressures which were exerted according to him on its candidature by the various institutions (apparatus of State, great parties and media) and sees in this context the success of the meeting of these sponsorships like the starting point of the “spearhead of the claims of the people” . Daniel Gluckstein was his campaign director.

Candidate of mayors?

Legitimacy
Since 2002 Gerard Schivardi centered his national policy on the defense of the Republic of: 36000 communes, with the return of the prerogatives full and whole of the municipal councils and the mayors. With this intention it furrowed France at many meetings with other mayors and city council men:

February 13rd, 2002, it takes part in creation with elected officials of the “defense committee of the communes and public services” in Minervois (34). In July 2003 he is elected general adviser on a programme of defense of the communes vis-a-vis the “forced” intercommunality and to defend the public services.

September 20th, 2003, it is one of the signataires calling with a national demonstration in Paris organized on the initiative of the National federation of the Freethinking and whose slogan was “we let us please keep our: 36000 communes in the Republic indivisible and laic”. The demonstrators also called with not with the “European” constitution.

January 22nd, 2005, it organizes with the defense committee of the communes a demonstration in Paris for the vote not with the European constitution. According to the organizers, it gathers: 10000 people.

April 16th, 2005, it takes part in a meeting for the vote not with reciprocity, in Paris, with many elected officials.

October 16th, 2005, it is one of the initiators of the “first national convention for the defense of the public services and of: 36000 communes, the reconquest of the political democracy and rupture with the European Union”.

On May 27th and 28th 2006, it takes part in the “second convention for the reconquest of the democracy and the rupture with the European Union” with 700 deputy of which many mayors.

October 6th, 2006, it belongs to a delegation of mayors received with the ministry for the interior on the call “organize to be resisted, defend and reconquer secularity” signed by 167 mayors.

November 18th, 2006, it speaks with a meeting places Nation, in Paris then takes the head of a national demonstration “for the reconquest of the democracy, for the rupture with the European Union, the defense of: 36000 communes, of the public services and secularity”. With resulting from this demonstration, it is designated as “candidate of the mayors” by forty mayors, elected by 300 of their colleagues, and trade unionists.

November 21st at the entry of the 89e congress of the MFA, with three other mayors, it distributes several thousands of specimens of its “letter to the mayors of France”. This letter was also distributed thereafter to the entry of the departmental assemblies of the MFA.

March 18th, a national meeting of mayors writes the profession of faith of the candidate.

Dispute
At a meeting of the committee of countryside of Ségolène Royal, Alain Richard, former minister for Defense and mayor of a commune of: 19000 inhabitants, is the first “to be moved”, according to Nouvel Observateur , that Gerard Schivardi is presented in the form of “a candidate of the mayors” and suggested that the Association of the mayors of France (MFA) seizes the subject.

March 21st, 2007 MFA, by the voices of Jacques Pélissard and Andre Laignel (respectively President (UMP) and General secretary (PS) of association), request with Gerard Schivardi “to remove any reference to the expression “candidate of the mayors””.

Gerard Schivardi refuses to yield with this request and supports whereas it is supported by mayors of any political edges, that the Association of the Mayors of France does not represent either all the mayors of France, as opposed to what the name of association could make believe and the monopoly of the representation of the mayors does not have. On his site of countryside, Gerard Schivardi publishes the declarations of several mayors, in particular those of Alain Outreman, PCF mayor of Achères and member of the office of the MFA, challenging the positions taken by Sirs Pélissard and Laignel in the name of AMF.

The MFA announces on March 26th, 2007 an legal action in summary procedure to prohibit in Gerard Schivardi the slogan “the candidate of the mayors” to the reason that this candidate is not the candidate of all the mayors and that the MFA does not support any candidate, Gerard Schivardi denounces this will of prohibition at the time of its press conference of March 23rd.

March 30th, 2007 the National Commission of control of the countryside for the presidential election validates finally the electoral profession of faith and the poster of Gerard Schivardi, whose new slogan is entitled “candidate of mayors”, after having invalidated that of “candidate of the mayors” (to the reason which it was likely to induce in error the voters while letting think that the candidate profited from the support of totality from some: 36000 mayors of France). Gerard Schivardi reacted against this “threat against the free expression of his program” by a recourse in front of the Constitutional council, that this last rejected while putting forward his incompetence.,

April 2nd the MFA obtains an summary order of the Court of Bankruptcy of Paris prohibiting with Gerard Schivardi to be presented in the form of a “candidate of the mayors”, it until the first turn of the presidential election and under obligation of 500€ per noted infringement.

The same day, in a memorandum the candidate continues to denounce these decisions of prohibitions. April 8th, Gerard Schivardi shows the PS and UMP “to have fomented a plot” to prevent it from presenting itself to the presidential election.

Countryside

Gerard Schivardi, of many mayors and representatives of his support group held several tens of public meetings or meeting in all France. In particular on April 1st, 2007 is held a meeting with the Sport hall of Paris. Gerard Schivardi makes full house and asserts to have joined together close to: 5000 people (: 4000 according to AFP).

April 13rd 2007 in conclusion of a meeting with Narbonne bringing together 500 people, Gerard Schivardi announces his will, with Daniel Gluckstein, to create a new working party. Questioned on the parliamentary chain on Tuesday, April 17, it specifies that this new formation, gathering mayors, militants trade unionists and laymen as well as the members of the Party of the workers, will be operational for the next municipal elections and cantonal. The secretary of the French Communist party, Marie-George Buffet, commented on the news while saying not very well not to see what Gerard Schivardi wanted to do, specifying that “PCF is there”.

Gerard Schivardi specified that it would not give a call to vote to the second turn of the presidential election and would place to him even a blank vote in the ballot box. During an interview on Canal+, he declares that he will never vote “for people who could put France and Europe at knees” .

With the first turn, on April 22nd, 2007, Gerard Schivardi obtained: 123711 votes, are 0,34% of the votes cast.
