General meeting

The general meeting is a mode of organization used by the associations law of 1901 (in France), the trade unions or the Actionnaire S of a Entreprise.

Associations

The associations, which are regroupings of people around a point or of a common objective (associations coeds, associations of women, etc) often function on the basis of general assembéles, which are in any event the best way of making a democratic decision in the presence of more possible members.

Procedures

With the Quebec, the procedures as a general meeting are generally dictated by the Code Morin.

==Entreprises in the form of sociétés==

The companies by action S, as those whose capital is composed of partnership shares (limited liability company, Coopérative), hold each year a Standard general meeting shareholders, associated and members.

The object is in particular to examine the accounts of the previous year and to make decisions concerning the Board of directors or management.

They can also hold of the Extraordinary general assemblies to make particular decisions, in particular the modifications concerning the statutes. When that an extraordinary general assembly is carried out on the same meeting that a standard general meeting, one speaks about mixed assembly.

Trade unions

The purpose of the general meeting is to make democratic decision of way. A general meeting is in general organized thanks to an office made up of a president, of a secretary and of a regulator (possibly each one of its stations can be assumed by several people), normally these people are there to allow that the debates occur in the calm one, that the day order is respected and that each one am entitled to the word, sometimes if the people chosen for the office are little honnètes, they can direct decision making, but it is always possible to revoke the office.

At the time of a general meeting each person present has the same weight at the time of decision making. The goal being to lead to the most consensual possible decisions so that the actions undertaken are to it in the most democratic possible way.

In order to ensure greatest possible legitimacy the general meeting, the people who in period of mobiilisation convene the general meetings (often trade unions) endeavor to inform to the maximum the public concerned on the behavior of the general meetings. In general they are the people present at the time of the first general meeting who fix the date of the following general meeting and so on.

The general meeting is also a normal event in the life of much of association or companies which under certain conditions is used to join together the whole of the members.

Methods of vote

The formulation of the proposal is proposed by the office, it does not have in its being formulation directed in favor of one or the other of the proposals. In the event of dissensions in its formulation it can simply call upon a person being for each possibilities and defend its position quickly (in 1 to 2 minutes)

In general at the time of the votes, 4 possibilities are offered:

  • does not take share with the vote (not taken into account in the calculation of the voices)

  • abstention (taken into account in the calculation of the voices)
  • against
  • for

Example of general meetings

In March 2006, in the French majority of the universities, of the general meetings were held in order to decide actions to carry out within the framework of the mobilization against the Loi for the equal opportunity (whose element more mediatized was the CPE which were finally withdrawn), CNE and the redundancies in the state education. These general meetings coordinated each other at the national level within the national coordination coed in order to carry out joint actions.
