French law of November 20th, 2007 relating to the control of immigration, integration and asylum

Deposited by Brice Hortefeux, this bill comprises relative tendencies with immigration, integration and the right of asylum. It is known mainly because of an amendment allowing to the applicants visa to be the proof of their biological filiation by means of a genetic Test. This last provision was qualified of “detail” by Francois Fillon, qualification which was criticized, in particular with the Socialist party, because of the use of this term by Jean-Marie Le Pen. Other bringings together with the Nazism or the Régime of Vichy were made. Many defense associations of the immigrants, trade unions and defense associations of the human rights also criticized other measurements such as the hardening of the conditions of Family gathering or the simplification of the measurements of distance from abroad.

The Constitutional council was seized, October 25th and 26th 2007 respectively, by more than sixty appointed and by more than sixty senators. In its decision of November 15th, 2007, he showed with nonconformity from article 63 (concerning the realization of data processing in personal matter revealing “, directly or indirectly, racial or ethnic origins”) and conformity, provided, of article 13 (genetic tests for the applicants of visa).

The law comprises 64 articles, numbered from 1 to 65. Article 63, initially reserved for the introduction of ethnic statistics, was declared anticonstitutional by the Constitutional council and disappeared from the version published of the law.
